A RESOLUTION CONFIRMING THE ADOPTION OF A
DECLARATORY RESOLUTION DESIGNATING CERTAIN AREAS
WITHIN THE CITY OF SOUTH BEND, INDIANA, COMMONLY
KNOWN AS
LOT 5 IN THE U.S. 31 INDUSTRIAL PARK, PHASE II
AS AN ECONOMIC REVITALIZATION AREA FOR
PURPOSES OF A TEN (10) YEAR REAL
PROPERTY TAX ABATEMENT FOR
STANZ CHEESE CO., INC. D /B /A STANZ FOODSERVICE, INC.
WHEREAS, the Common Council of the City of South Bend, Indiana, has adopted a
Declaratory Resolution designating certain areas within the City as Economic
Revitalization Areas for the purpose of tax abatement consideration; and
WHEREAS, a Declaratory Resolution designated the area commonly known as Lot 5 in
the U.S. 31 Industrial Park, Phase II, South Bend, Indiana, and which is more particularly
described as follows:
A PART OF THE SOUTHWEST QUARTER OF SECTION 17, TOWNSHIP 38
NORTH, RANGE 2 EAST, GERMAN TOWNSHIP, CITY OF SOUTH BEND, ST.
JOSEPH COUNTY, INDIANA:
LOT 5, AS SAID LOT IS KNOWN AND DESIGNATED ON THE PRIMARY PLAT
OF U.S. 31 INDUSTRIAL PARK, PHASE II, MORE PARTICULARLY DESCRIBED
AS FOLLOWS:
COMMENCING AT A 1 INCH PIPE MARKING THE SOUTHWEST CORNER OF
SAID SECTION 17, THENCE SOUTH 89 DEGREES 58'26" EAST, ON THE SOUTH
LINE OF SAID SECTION 17, A DISTANCE OF 1303.60 FEET; THENCE NORTH
ZERO DEGREES 12'42" WEST, ON THE EAST LINE OF THE WEST HALF OF
THE SOUTHWEST QUARTER OF SAID SECTION 17, A DISTANCE OF 1526.61
FEET TO THE POINT OF BEGINNING; THENCE NORTH 89 DEGREES 57'04"

A 380.00 FOOT RADIUS CURVE TO THE LEFT, AN ARC LENGTH OF 191.96

A DISTANCE OF 189.93 FEET) TO A 5/8 INCH BAR AND CAP; THENCE NORTH
37 DEGREES 47'32" WEST, 103.76 FEET TO A 5/8 INCH BAR AND CAP; THENCE
NORTHWESTERLY, ALONG A 320.00 RADIUS CURVE TO THE RIGHT, AN ARC
LENGTH OF 209.62 FEET TO A 5/8 INCH BAR AND CAP; THENCE NORTH ZERO
DEGREES 15'35" WEST, 684.55 FEET TO A 5/8 INCH BAR AND CAP ON THE
NORTH LINE OF THE SOUTHWEST QUARTER OF SAID SECTION 17; THENCE
SOUTH 89 DEGREES 57'16"-EAST, ON SAID NORTH LINE, 853.92 FEET TO THE
EAST LINE OF THE WEST HALF OF THE SOUTHWEST QUARTER OF SAID
SECTION 17; THENCE SOUTH ZERO DEGREES 12'42" EAST, ON THE EAST
LINE OF THE WEST HALF OF THE SOUTHWEST QUARTER OF SAID SECTION
17, A DISTANCE OF 1135.48 FEET TO THE POINT OF BEGINNING.
and which has Key Number 25- 1009 - 015209, as an Economic Revitalization Area; and
WHEREAS, notice of the adoption of a Declaratory Resolution and the public hearing
before the Council has been published pursuant to Indiana Code 6 -1.1- 12.1 -2.5; and
WHEREAS, the Council held a public hearing for the purposes of hearing all
remonstrances and objections from interested persons; and
WHEREAS, the Council has determined that the qualifications for an economic
revitalization area have been met.
NOW, THEREFORE, BE IT RESOLVED by the Common Council of the City of South
Bend, Indiana, as follows:
SECTION I. The Common Council hereby confirms its Declaratory Resolution
designating the area described herein as an Economic Revitalization Area for the
purposes of tax abatement. Such designation is for Real property tax abatement only and
is limited to two (2) calendar years from the date of adoption of the Declaratory
Resolution by the Common Council.
SECTION II. The Common Council hereby determines that the property owner is
qualified for and is granted Real property tax deduction for a period of ten (10) years, and
further determines that the petition, the Memorandum of Agreement between the
Petitioner and the City of South Bend, and the Statement of Benefits comply with
Chapter 2, Article 6, of the Municipal Code of the City of South Bend and Indiana Code
6- 1.1 -12 etseo.
SECTION III. This Resolution shall be in full force and effect from and after its
adoption by the Common Council and approved by the Mayor.
