City Clerk RESOLUTION NO. 3S`I S -6 b A RESOLUTION OF THE COMMON COUNCIL OF THE CITY OF SOUTH BEND, INDIANA, ADOPTING A WRITTEN FISCAL PLAN AND ESTABLISHING A POLICY FOR THE PROVISION OF SERVICES TO AN ANNEXATION AREA IN GERMAN TOWNSHIP (JOHN D. AND JAY L. GILLIS ANNEXATION AREA) WHEREAS, there has been submitted to the Common Council of the City of South Bend, Indiana, an Ordinance and a petition by the sole (100 %) property owner which proposes the annexation of real estate located in German Township, St. Joseph County, Indiana, which is described more particularly in Section I of this Resolution, and; WHEREAS, the territory proposed to be annexed encompasses approximately 12.72 acres of vacant, undeveloped land, which property is at least 12.5% contiguous to the current City limits, i.e., approximately 14% contiguous, generally located at the southeast corner of Portage and Brick Roads. This annexation territory is intended for ultimate development as a medical office complex, and is proposed to be zoned "O" (Office) upon incorporation into the City limits and approval by the Common Council. As the site of a future medical office complex, this annexation territory will require a basic level of municipal public services of a non - capital improvement nature, including police and fire protection, street and road maintenance, street sweeping, flushing, snow removal, and sewage collection, as well as services of a capital improvement nature, including street and road construction, street lighting, a sanitary sewer system, a water distribution system, a storm water system and drainage plan; and WHEREAS, the Common Council of the City of South Bend, Indiana, now desires to establish and adopt a fiscal plan and establish a definite policy showing: (1) the cost estimates of services of a non - capital nature, including street and road maintenance, sewage collection, street sweeping, flushing, and snow removal, police and fire protection, and other non - capital services normally provided within the corporate boundaries, and services of a capital improvement nature, including street and road construction, street lighting, a sanitary sewer extension, a water distribution system, and a storm water system to be furnished to the territory to be annexed; (2) the method(s) of financing those services; (3) the plan for the organization and extension of those services; (4) that services of a non - capital nature will be provided to the annexed area within one (1) year after the effective date of the annexation, and that they will be provided in a manner in standard and scope to similar non - capital services provided to areas within the corporate boundaries of the City of South Bend, regardless of similar topography, patterns of land use, or population density; (5) that the services of a capital improvement nature will be provided to the annexed area within three (3) years after the effective date of the annexation in the same manner as the services are provided to areas within the corporate boundaries of the City of South Bend, regardless of similar topography, patterns of land use, or population density, and in a manner consistent with federal, state and local laws; and (6) the plan for hiring the employees of other governmental entities whose jobs will be eliminated by the proposed annexation; and WHEREAS, the Board of Public Works of the City of South Bend, and the Board of Public Safety of the City of South Bend, have each approved a written fiscal plan and established a policy for the provision of services to the territory proposed to be annexed, which plan and policy the Common Council finds to be appropriate and in the best interest of the City, and, which it desires to adopt. NOW, THEREFORE, BE IT RESOLVED BY THE COMMON COUNCIL OF THE CITY OF SOUTH BEND, INDIANA, AS FOLLOWS: Section I. It is in the best interest of the City of South Bend and the area proposed to be annexed that the following described real property located in German Township, St. Joseph County, Indiana, be annexed to the City of South Bend: THAT PART OF THE SOUTHWEST QUARTER OF SECTION 15 AND PART OF THE NORTHWEST QUARTER OF SECTION 22, BOTH BEING IN TOWNSHIP 38 NORTH, RANGE 2 EAST, GERMAN TOWNSHIP, ST. JOSEPH COUNTY, INDIANA WHICH IS DESCRIBED AS: BEGINNING AT THE SOUTHWEST CORNER OF SAID SECTION 15; THENCE NORTH (ALL BEARINGS ASSUMED) ALONG THE WEST LINE OF SAID SECTION 15, 20 FEET MORE OR LESS TO A POINT OF INTERSECTION WITH THE NORTH LINE OF BRICK ROAD EXTENDED WEST; THENCE EAST ALONG SAID EXTENSION AND THE NORTH LINE OF BRICK ROAD, 1,320 FEET MORE OR LESS TO THE EAST LINE OF THE WEST HALF OF THE SOUTHWEST QUARTER OF SAID SECTION 15; THENCE SOUTH ALONG SAID EAST LINE AND THE EAST LINE OF THE WEST HALF OF THE NORTHWEST QUARTER OF SAID SECTION 22, 449.5 FEET MORE OR LESS TO THE NORTH LINE OF THE PLAT OF "PORTAGE MANOR" AS RECORDED IN THE RECORDS OF THE ST. JOSEPH COUNTY RECORDER'S OFFICE; THENCE ALONG THE NORTH LINE OF SAID PLAT AND IT'S WESTERLY EXTENSION, 1,140 FEET MORE OR LESS TO THE EASTERLY LINE OF PORTAGE ROAD; THENCE N. 200 — 21' -19" W. ALONG SAID EASTERLY LINE 319.09 FEET MORE OR LESS; THENCE S. 690- 38' -41" W., 70.00 FEET MORE OR LESS TO THE WEST LINE OF SAID SECTION 22; THENCE NORTH ALONG SAID WEST LINE, 129.38 FEET MORE OR LESS TO THE PLACE OF BEGINNING. Section H. It shall be and hereby is now declared and established that it is the policy of the City of South Bend, to furnish services to said territory of a non - capital nature, such as police and fire protection, street and road maintenance, sewage collection, street sweeping, flushing, and snow removal, within one (1) year of the effective date of the annexation, in a manner equivalent in standard and scope to the services furnished by the City to other areas of the City regardless of similar topography, patterns of land use, or population density; and to furnish to said territory services of a capital improvement nature, such as street and road construction, street lighting, a sanitary sewer extension, a water distribution system, a storm water system, and drainage plan, within three (3) years of the effective date of the annexation in the same manner as those services are provided to areas within the corporate boundaries of the City of South Bend regardless of similar topography, patterns of land use, or population density, and in a manner consistent with federal, state and local laws, procedures, and planning criteria. Section III. The Common Council for the City of South Bend shall and does hereby now establish and adopt The Fiscal Plan as set forth in Exhibit "A ", attached hereto and made a part hereof, for the furnishing of said services to the territory to be annexed, which Fiscal Plan provides among other things, that an extension of the sanitary sewer network now being constructed to Brick Road by "The Oaks" subdivision developer will be extended from that point to the annexation territory at its developer's expense; that if a new water main line is required, it will be at the developer's expense; that street lighting on Portage Avenue should be adequate for illumination; that if new public streets or other rights of way are needed, they will be installed at the developer's expense, and that drainage facilities will be constructed by and at the expense of the developer; and which Fiscal Plan further provides for additional development standards under Section IV Development Criteria on Page 9. Section IV. This Resolution shall be in full force and effect from and of its date of adoption by the Common Council and approval by the Mayor. Gillis Annexation Area 3 SECTION I. INTRODUCTION A. General This Fiscal Plan represents the City of South Bend's (hereinafter, "City ") policy for the annexation of property in German Township, St. Joseph County, Indiana (hereinafter, "Annexation Area "), and was developed through the cooperative efforts of the Area Plan Commission and the following City Departments: Legal Department Department of Public Works South Bend Fire Department South Bend Police Department Department of Code Enforcement Department of Community and Economic Development Department of Administration and Finance SECTION II. GENERAL DATA A. Location The Annexation Area is generally located at the southeast corner of Portage and Brick Roads. See Map 1. B. Legal Description The Annexation Area is part of the Southwest Quarter of Section 15, and part of the Northwest Quarter of Section 22, both being in Township 38 North, Range 2 East, German Township, St. Joseph County, Indiana. For a complete legal description see Table 2. C. Contiguity The Annexation Area is at least 1/8 (12.5 %) contiguous to the current City limits: Contiguous 468.47 feet 14% Non - Contiguous 3.447.97 feet 86% Total 3,447.97 feet 100% John D. and Jay L. Gillis Annexation Area 4 D. Size of Annexation Area The Annexation Area is 12.72 acres in area. E. Buildings and Land Use The Annexation Area has no buildings and is vacant and undeveloped. Medical offices are proposed. F. Zoning & Subdivisions The site is zoned "R" Residential in unincorporated St. Joseph County. It is proposed to be zoned "O" Office upon approval of the City Council and incorporation into the City of South Bend. G. Population No people currently reside in the Annexation Area. H. Tax Rate The tax rates used are those of 2004 payable in 2005. The Township Rate will decrease by $0.1027 per $100.00 of assessed valuation with the deletion of the Fire Fighting Fund, the Fire Equipment Debt Fund and the Cumulative Fire assessments. The tax rate for the Annexation Area will increase by $2.2655 with the addition of the City and Town Rate, the Redevelopment District Rate and the South Bend Transpo Rate. The net increase in property taxes will be $2.1628 per $100.00 of assessed valuation. Table] shows representative tax rate information as published by the St. Joseph County Auditor. I. Assessments 2004 payable 2005, St. Joseph County Auditor property tax records: Land: $27,600.00 Improvements: $0.00 Net: $27,600.00 J. Municipal Legislative District The Annexation Area will be in the 1 st District. John D. and Jay L. Gillis Annexation Area 5 K. Hiring Plan It is anticipated that this annexation will not result in the elimination of jobs for employees of any other governmental entities. The German Township Trustee has been notified of this Annexation. SECTION III. MUNICIPAL SERVICES A. Public Works Sewer - The public sanitary sewer network is being extended to Brick Road east of the site by the developer of the recently annexed "The Oaks" subdivision (Gregory A. Kizer Annexation Area). Construction of the public infrastructure in that subdivision is nearly complete. The sewer at Brick Road is eight inches in diameter. The developer of this property will need to extend sewer lines to the site from that point. Sewer revenues from the development will be sufficient to provide those services to the site. No additional public expenditures will be needed to extend existing sewer main facilities for this Annexation Area. Water - A 12" water main is located on the west side of Portage Road. A 12" water main is expected to be constructed on the south side of Brick Road from Portage to Foxfire Drive. Water revenues from the development will be sufficient to provide those services to the site. No additional public expenditures will be needed to extend existing water main facilities. Extensions of, or taps into sanitary sewer and water lines shall be governed by I.C. 36- 9 -22 -2, I.C. 8 -1.5 -3 and 4, and the rules and regulations of the South Bend Water Works and Sewer Utility. Street Lighting - Additional revenue to the General Fund from this annexation area will be sufficient to pay for street light operations on Portage Avenue. Waivers of Annexation - No waivers of annexation are in effect for the Annexation Area. Streets - The current proposal for development of the Annexation Area does not create new public streets or other right of way. However, if in the future such improvements are provided, the developer will be required to construct new public streets to access the lots proposed for development. The annexation area does include about 1800' of existing roadways that will be brought into the City's jurisdiction. These streets will add mileage to the roadway inventory. The new mileage will add to the state's payments to the Motor Vehicle Highway Fund and Local Road and Street Fund sufficient for street maintenance, sweeping, and snow removal. Gillis Annexation Area 6 Additional revenue to the General Fund from this annexation area will be sufficient to pay for street light operations on Portage Highway and on Brick Road. Drainage Plan - Drainage facilities will be required to be constructed by the developer. Cost of road maintenance will be greatly reduced during the early years of this development in anticipation that major repairs will not be needed. B. Police Department The Annexation Area would be expected to be added to the already existing BEAT 22. Police patrols, traffic enforcement, and emergency responses will be part of the services the City will offer to this area. This proposed annexation would require officers to cover a relatively small additional area to this beat. The Annexation Area is located in an area of the city that is expected to continue to grow, both in commercial development as well as residential. At this time it is not expected that this annexation would cause calls for service to increase significantly and it is not anticipated that it will be necessary to increase police patrols beyond the already existing beat patrol at this time. The area under consideration is not expected to cause any unusual problems. Cost for servicing this area would be expected to be absorbed by the existing budget of the Police Department, as the addition of this area would not be significant to the point of having to increase any budgetary items. Police services and response time in this area can be expected to be comparable and consistent with that as in all other areas of the City. Police coverage to this area could begin immediately upon annexation and coordination of the conversion of the 911 emergency phone system for that area. John D. and Jay L. Fire Department The Annexation Area will be serviced primarily by Station #11, located at 3505 N. Bendix Drive approximately one point one (1.1) miles away. Additional Fire Department units would respond from Fire Station #7 located at 1616 Portage Avenue which is approximately three (3.0) miles away. The South Bend Fire Department does not foresee any unusual fire protection problems related to this annexation. Response times will be comparable to other areas of the City. No additional equipment will need to be purchased or personnel hired to service the Annexation Area. Adequate water supply will be necessary as development takes place. Note: The cost ofservice for this Annexation Area is based on the number ofparcels. Gillis Annexation Area 8 D. Code Enforcement The Annexation Area will be added to Area 8. The Department of Code Enforcement will be able to provide services to the Annexation Area with comparable response times. The Department will respond to calls for service upon the effective date of the Annexation. Environmental Services Environmental Services provides wastewater treatment and administers the City's Solid Waste service. These services are supported by user fees, and are paid through the Water Works billing system. Industrial, commercial and apartment customers are not served. F. Administrative Services The City of South Bend provides a wide range of services other than those noted above, such as the Mayor's office, the Legal Department, and the Parks & Recreation. These services are available upon the effective date of the Annexation. Full and dedicated response for non - capital services will be in place within one year of the effective date of the Annexation. Costs for these services have not been calculated. The incorporation of the Annexation Area will not effect the provision of other services currently provided to this property on a county-wide basis. The St. Joseph County Health Department, the St. Joseph County Public Library, the Area Plan Commission and the St. Joseph County/South Bend Building Department are some of the county-wide agencies and their services that will continue to provide the same type and level of services to the Annexation Area. County -wide services will continue to be supported by the County and Township tax rates that will remain in effect. John D. and Jay L. Gillis Annexation Area 9 SECTION IV. DEVELOPMENT CRITERIA The Annexation Area is an approximately thirteen (13) acre parcel at the southeast comer of Portage and Brick Roads. The other three corners of Portage and Brick Roads are developed, two residentially, and one with a church. Residential uses exist on the balance of the properties on either side of Portage and Brick Roads. One more church is located on Brick Road directly across from the Annexation Area. As a result of the existing surrounding land uses, the use and development of this site becomes important relative to its relationship with the existing surrounding uses. Service- oriented uses that could benefit residents of the immediate surrounding area, should and can be considered as an alternative land use at prominent locations. This particular parcel is one of those locations that, if developed to higher than required standards, can exist as an alternative use. The development criteria noted below are designed to accommodate this use within a largely residentially -zoned and residentially - developed area: A. That all buildings be placed in a "cluster" pattern so as to minimize their exposure to Brick Road and provide a more compact development. B. That the parking areas be located in such a manner that they have minimum exposure to Brick and Portage Roads. This can be accomplished through a combination of landscaping and using the clustered buildings as buffering. Parking areas, to the fullest extent possible, should not be used as a de -facto design element between buildings and the public street. C. That a pedestrian connectivity be established and maintained from east to west, and from north to south. This may be accomplished by either traditional sidewalks along Portage and Brick Roads, or internally as a part of the overall landscape design. D. That the overall design of the site treat the SE corner of Brick and Portage Roads (the NW corner of the site) as a prominent feature for the area in general, and the intersection in particular. This can be accomplished by a combination of landscaping, the preserving of positive natural features, and by subdued signage E. That retention and detention areas be designed so as to be incorporated as a positive landscaping feature in the development. F. That only one entrance into the site from Brick Road be permitted. This will diminish the impact of this higher density development and reduce the number of conflict points entering and exiting the site. John D. and Jay L. Gillis Annexation Area 10 SECTION V. FISCAL IMPACT 1) Essential city services can be made available to the residents (and territory) of the Annexation Area in a timely and comparable fashion per the requirements of State law and this fiscal plan. 2) The City is financially able to support city services to the territory sought to be annexed. 3) Required improvements made by the petitioner and/or owner of the parcels must be made in accordance with the standards of the City of South Bend. 4) Required improvements made by the City will be completed within the time frames provide by State law and this fiscal plan. 5) All figures are estimates. Final cost of capital expenditures, if any, will not be determined until bids are publicly solicited, contracts are awarded and projects are closed out. 6) Property tax revenue and land assessment estimates are based on a combination of. 2004 payable 2005 tax rates, taxes paid in previous years by a comparable development, estimates of units built, estimates of unit values and land assessments, and tax abatements or adjustments, if any. Tax rates are subject to change every year. 7) Department expenditures and revenues are derived from the City of South Bend Budget. 8) The estimated costs to provide services, noted in Section III, Municipal Services, is a City -wide average based on a particular budget year. In the case of the proposed development in the Annexation Area, some of these services will not be required or possibly requested for many years. Gillis ANNEXATION Dear Ms. Pfiefer: I am attaching for filling, the above - referenced resolution, which is a companion to Bill No. 77 -05. This Bill proposes to voluntarily annex contiguous territory in German Township to the City of South Bend. The resolution indicates the approval and adoption by the Common Council of the written plan and policy attached thereto concerning the provision of services, both capital and non - capital in nature, to the territory to be annexed. This Annexation is a 12.72 acre parcel at the southeast comer of Portage and Brick Roads. All public improvements, if any, will be required to be done at the expense of the developer. Please note that on page 9 of the fiscal plan, that additional development criteria are being suggested. I am requesting that the attached resolution be placed on the January 9, 2005 agenda of the Common Council meeting at which the companion Bill is given Second Reading.
