HomeMy WebLinkAbout6I(1) I (,) sidt 2: Department of kr ' z Community Investment Memorandum October 16, 2014 TO: Redevelopment Commission FROM: David Relos, Economic Resources SUBJECT: Resolution No. 3253 TIF Realignment Plan Amendments, Area Additions On August 28, 2014, the Commission approved Declaratory Resolutions 3227, 3228, and 3229, beginning the process to realign certain Development Areas within the City. Per Indiana Code, Resolutions then go to the Area Plan Commission and Common Council for approval, followed by a Commission public hearing and consideration of Confirming Resolutions. With the realignment of certain existing Development Areas into other existing Development Areas, it has been planned to amend the Development Plans for these new areas. Also, as part of the approval process, it has been determined that adding the City Cemetery, Leeper Park, and the Museum Campus into the realigned AEDA, would allow improvements to be made to these three areas. Staff requests approval of Resolution No. 3253, authorizing staff to amend and bring back to the Commission amended Development Plans for the AEDA and NNDA, and adding City Cemetery, Leeper Park, and the Museum Campus to the above Development Area. 227 W.JEFFERSON BLVD. SOUTH BEND, IN 46601 I P: 574-235-9371 I FAX: 574-235-9021 I SOUTHBENDIN.GOV RESOLUTION NO.3253 RESOLUTION OF THE SOUTH BEND REDEVELOPMENT COMMISSION DETERMINING TO PROCEED WITH AMENDMENTS TO CERTAIN DEVELOPMENT PLANS WHEREAS, the South Bend Redevelopment Commission (the "Commission"), governing body of the City of South Bend Department of Redevelopment (the "Department") and the Redevelopment District of the City of South Bend, Indiana (the "Redevelopment District"), exists and operates under the provisions of the Redevelopment of Cities and Towns Act of 1953 which has been codified in Indiana Code 36-7-14, as amended from time to time (the "Act"); and WHEREAS, the Commission on August 28, 2014, approved and adopted its Resolution No. 3227 entitled "Resolution of the South Bend Redevelopment Commission Designating and Declaring a Certain Area as a Redevelopment Area for the Purpose of Amending the Boundaries of the South Side Development Area and its Allocation Area and to Amend the Development Plan for the South Side Development Area" (the "SSDA Declaratory Resolution"); and WHEREAS, the SSDA Declaratory Resolution (i) designated and declared a certain area within the City to be a redevelopment area and an allocation area for purposes of tax increment financing (the "SSDA Expansion Area") to expand the existing South Side Development Area (the "South Side Area") to include the former Scottsdale Community Center in the South Side Area; (ii) added the Scottsdale Community Center to the South Side Area acquisition list; and (iii) approved an amendment to the development plan for the South Side Area(as amended, such plan shall be referred to herein as the "SSDA Plan"); and WHEREAS, the Commission on August 28, 2014, approved and adopted its Resolution No. 3228 entitled "Resolution of the South Bend Redevelopment Commission Designating and Declaring Certain Areas as Redevelopment Areas and Adding Certain Territory from the South Bend Central Development Area for the Purpose of Amending the Boundaries of the Northeast Neighborhood Development Area and the Northeast Neighborhood Development Area Allocation Area No.1 and Approving an Amendment to the Development Plan for Said Area" (the "NNDA Declaratory Resolution"); and WHEREAS, the NNDA Declaratory Resolution (i) consolidated into the Northeast Neighborhood Development Area, which will be known as the River East Development Area, (the "Northeast Neighborhood Area") certain territory of the South Bend Central Development Area (the "Central Development Area"); (ii) designated and declared certain areas within the City to be redevelopment areas and allocation areas for purposes of tax increment financing (the "NNDA Expansion Area") to expand the existing Northeast Neighborhood Area; (iii) transferred certain property previously included on the Central Development Area acquisition list to the NNDA acquisition list; and (iv) approved an amendment to the development plan for the Northeast Neighborhood Area (as amended, such plan shall be referred to herein as the "NNDA Plan"); and WHEREAS, the Commission on August 28, 2014, approved and adopted its Resolution No. 3229 entitled "Resolution of the South Bend Redevelopment Commission Designating and Declaring Certain Areas as Economic Development Areas to Amend the Boundaries of the Airport Economic Development Area by Adding the Remainder of the South Bend Central Development Area, Certain Territory of the West Washington-Chapin Development Area and Certain Expansion Areas to the Airport Economic Development Area, Designating Such Territories and Areas as Part of the Airport Economic Development Area Allocation Area No. 1 and Approving of an Amendment to the Development Plan for the Airport Economic Development Area" (the "AEDA Declaratory Resolution"); and WHEREAS, the AEDA Declaratory Resolution (i) consolidated into the Airport Economic Development Area, which will be known as the River West Development Area, (the "Airport Area") the portion of the remaining territory of the Central Development Area; (ii) consolidated certain territory of the West Washington-Chapin Development Area (the "WWC Area") into the Airport Area; (iii) designated and declared certain areas within the City to be economic development areas and allocation areas for purposes of tax increment financing (the "Airport Area Expansion Areas") to expand the existing Airport Area; (iv) removed certain territory from the Airport Area; (v)terminated the allocation provisions relating to the Downtown Medical Services District within the City; (vi) added certain parcels of property to the Airport Area acquisition list; (vii) transferred certain property previously included on the Central Development Area acquisition list to the Airport Area acquisition list; (viii)transferred certain property previously included on the WWC Area acquisition list to the Airport Area acquisition list; and (ix) approved an amendment to the economic development plan for the Airport Area (as amended by the AEDA Plan Amendment, such plan shall be referred to herein as the "AEDA Plan"); and WHEREAS, upon the conclusion of the actions required by the Act to confirm the SSDA Declaratory Resolution, the NNDA Declaratory Resolution and the AEDA Declaratory Resolution, the Commission directs the Department of Community Investment (the "Department") staff to prepare amendments to the NNDA Plan (the "NNDA Plan Amendment") and the AEDA Plan (the "AEDA Plan Amendment") for the purpose of realigning the goals and objectives of each of such plans and to consider whether any further amendment of the SSDA Plan is necessary or appropriate as a result of the adoption of the foregoing declaratory resolutions; and WHEREAS, the Commission desires that the Department staff include, as part of the AEDA Plan Amendment, amendments adding three (3) properties commonly known as Leeper Park, the Museum Campus and City Cemetery to the Airport Area; NOW THEREFORE, BE IT RESOLVED by the South Bend Redevelopment Commission as follows: 2 US.55024256.01 1. Following the completion of the actions required by the Act to confirm the declaratory resolutions referenced herein, the Commission hereby directs the Department staff to prepare and present to the Commission for its consideration the NNDA Plan Amendment and the AEDA Plan Amendment. The Department staff is further directed to prepare and present to the Commission an amendment to the SSDA Plan if the Department staff deems it necessary or appropriate. 2. This Resolution shall be in full force and effect after its adoption by the Commission.
