HomeMy WebLinkAboutProhibiting the Obscene, Phonograph RecordsORDINANCE No. 3751 Passed by the Common Council of the City of South Bend, MAY 8TH 10 Presented by me to the Mayor of the City of South Bend, MAY 9TH 19350 Clerk of Common Council Approved and signed by me MAY 9TH Io§ Clerk �7 N0. c-O 7� AN ORDINANCE PROHIBITING THE SALE, LENDING, GIVING AWAY, OR POSSESSION OF OBSCENE, LEWD, INDECENT OR LASCIVIOUS PHONOGRAPH RECORDS, SOUND TRANSCRIPTIONS, WIRE RECORDINGS OR SIMILAR DEVICE OR ARTICLES, AND PROVIDING PENALTIES FOR VIOLATION THEREOF. BE IT ORDAINED by the Common Council of the City of South Bend, Indiana: Section 1. It shall be unlawful for any person, firm or corporation to sell, lend or lease, offer to sell, lend or lease, or give away or offer to give away, or be in possession of, with or without intent to sell, lend or give away, any phonograph records, sound transcriptions, wire recordings, or similar devices or articles which contain obscene, lewd, indecent or lascivious language. Section 2. Any person, firm or corporation convicted of a violation of this ordinance shall be punished by a fine not to exceed Three Hundred 0300.00) Dollars, to which may be added imprisonment not to exceed six (6) months.
