AN ORDINANCE PROHIBITING THE SALE, LENDING,
GIVING AWAY, OR POSSESSION OF OBSCENE, LEWD,
INDECENT OR LASCIVIOUS PHONOGRAPH RECORDS,
SOUND TRANSCRIPTIONS, WIRE RECORDINGS OR
SIMILAR DEVICE OR ARTICLES, AND PROVIDING
PENALTIES FOR VIOLATION THEREOF.
BE IT ORDAINED by the Common Council of the City of
South Bend, Indiana:
Section 1. It shall be unlawful for any person, firm or
corporation to sell, lend or lease, offer to sell, lend or lease,
or give away or offer to give away, or be in possession of, with
or without intent to sell, lend or give away, any phonograph
records, sound transcriptions, wire recordings, or similar devices
or articles which contain obscene, lewd, indecent or lascivious
language.
Section 2. Any person, firm or corporation convicted of
a violation of this ordinance shall be punished by a fine not to
exceed Three Hundred 0300.00) Dollars, to which may be added
imprisonment not to exceed six (6) months.
Section 3. This ordinance shall be in full force and
effect from and after its passage by the Common Council, its
approval by the Mayor and its legal publication.
