HomeMy WebLinkAboutRequiring NY Central Railroad Co. to Provide & Maintain Automatic Flash Light Signals at Crossing Tracks Where Intersect with Washington StreetORDINANCE No. 3833 Passed by the Common Council of the City of South Bend, JULY 23RD. �935-1 Presented by me to the Mayor of the City of South Bend, 19351 Clerk of Common Council Approved and signed by Clerk ORDINANCE NO. 3 AN ORDINANCE REQUIRING THE NEW YORK CENTRAL RAILROAD COMPANY TO PROVIDE A1V'D MAINTAIN AUTOMATIC FLASH LIGHT SIGNALS AT THE GRADE CROSSING OF THE TRACKS OF SAID RAILROAD WHERE THE SAME INTERSECT WITH WASHINGTON STREET FOR THE .PROTECTION OF HUMAN LIFE, PROVIDING FOR PENALTIES FOR THE VIOLATION THEREOF, AND RE- PEALING ALL ORDINANCES IN CONFLICT HEREOF. BE IT ORDAINED BY THE COMMON COUNCIL OF THE CITY OF SOUTH BEND, INDIANA: ION 1. That it shall be the duty of The New York Central ad Company to install, maintain, operate and renew automatic sh light signals at the crossing of Washington Street in the ty of South Bend, Indiana, where the same intersects with the of said railroad company. ON 2. That said railroad company coming under the pro- sions of Section 1 of this ordinance is granted and given a riod of six (6) months from and after the passage of this to comply with the terms thereof; that it shall be the ties of such company to notify the City of South Bend anytime thin the period granted herein that it has complied with the is as herein set forth as to such installation of flash signals and, until such notification is received, the said company shall maintain such protection at the crossing now exists. This period may be extended upon proper showing the Railroad Companies that difficulty is being encountered aining the necessary materials. 3. Any persons, person, firm or corporation who vio- tes any of the provisions of this ordinance or any section or thereof, or shall'fail or refuse to perform any of the re- ements or duties herein required of him, or it, to be performed 1, upon conviction, be fined in a sum not to exceed Fifty .00) Dollars. Each failure shall constitute a separate offense each day shall constitute a separate failure. 4. All ordinances or parts of ordinances in conflict ith this ordinance are hereby repealed. ECTION 5. If any provisions of this ordinance, or the appli- ation thereof, is held invalid, such invalidity shall not affect ther provisions or applications of the ordinance which can be iven effect without the invalid provisions or application, and to Us end the provisions of this ordinance are declared to be everable. I,CTION 6. This ordinance shall be in full force and effect and after its passage and approval by the Mayor and due publi- tion thereof as provided by law.
