RATTVVTVr, ANn rnVVTT)MTATS A WHEREAS, heretofore, to -wit: on the 26th day of January, 1953, the City of South Bend, Indiana, acting by and through its Board of Public Works and Safety, entered into the following contract with Northern Indiana Transit, Inc.: C O N T R A C T THIS CONTRACT, made and entered into this 26th day of January, 1953, by and between the CITY OF SOUTH BEND, INDIANA, acting by and through its Board of Public Works and Safety, hereinafter called the First Party, and NORTHERN INDIANA TRAN- SIT, INC., a corporation organized under the laws of the State of Indiana, its successors and assigns, hereinafter called the Second Party. WITNESSETH: The parties hereto agree that the certain contract made be- tween the parties and confirmed by Ordinance of the Common Council of the City of South Bend, on or about the 13th day of May, 1940, as amended by a contract entered into on the 13th day of February, 1948 between the parties and thereafter confirmed by the Common Council, and as further amended by a contract entered into on the 8th day of July, 1950 between the parties and thereafter confirmed by the Common Council, and as further amended by contract entered into on the 10th day of March, 1952, and thereafter confirmed by the Common Coundil, shall be and is hereby amended in each of the follow- ing respects: All provisions in said contract, as amended, regarding the cash fare of 1W and token fare of 2 tokens for 25¢, and 5¢ school fare now existing, are amended as follows, to -wit: Cash fare . . . . . W Token fare _$ tokens for 500 (Each token giving a passenger the right to one ride or trip on a bus). School fare High School Students . 10¢ cash Grade School Students. . . . 50 cash All provisions in said contract, as amended, regarding transfers, shall remain the same. The Second Party shall furnish service to the public over the routes now presently established. Said contract made between the parties on the 13th day of May, 1940, as amended by the contract of February 13, 1948, as further amended by contract of July 8, 1950, and as further amended by contract of March 10, 1952, and as hereinabove amended, sh.11 be and is hereby continued in full force and effect. Martin President and General anager AND WHEREAS, said contract has been submitted by said Board of Public Works and Safety of the City of South Bend, Indiana, to the Common Council of said City for its consideration and action thereon: Section 1. BE IT ORDAINED by the Common Council of the City of South Bend, Indiana, that the foregoing contract and agree- ment, made and entered into on the 26th day of January, 1953, by the City of South Bend, Indiana, acting by and through its Board of Pub- lic Works and Safety, and Northern Indiana Transit, Inc., be and the same is hereby in all things approved, ratified and confirmed, and said Northern Indiana Transit, Inc., its successors and assigns, is hereby granted the right, privilege and authority as in said contract and agreement set forth, and in accordance with the terms, provisions and contents thereof. Section 2. This ordinance shall take effect and be in force from and after its passage by the Common Council and approval by the Mayor of the City of South Bend, Indiana.
