ORDINANCE NO. 4058
AMENDMENT OF ZONING ORDINANCE
(An Ordinance amending Ordinance No. 3702, adopted June 13, 1949, and
commonly known as the Zoning Ordinance of the City of South Bend.
WHEREAS, Colpaert Realty Corporation contemplates the development of
Belleville Shopping Center, which is bounded on the North by Western Avenue, on
the East by Lombardy Drive and on the South by a line parallel to and approximately
679 feet South of the South line of Western Avenue; and
WHEREAS, Colpaert Realty Corporation has petitioned for changes of zoning
of three tracts in or adjacent to said proposed shopping area; and
WHEREAS, the City Plan Commission has recommended that the zoning of said
three tracts be changed as herein provided.
NOW, THEREFORE, BE IT ORDAINED by the Common Council of the City of
South Bend that Ordinance No. 3702, which Ordinance is commonly known as the
Zoning Ordinance of the City of South Bend, be amended to read as follows:
Section 1
The following described real estate situated in the City of South Bend
be and the same is hereby rezoned as "C" Commercial Use District and "E°
Height and Area District:
Beginning at a point in the West line of Lombardy Drive 504 feet
South of the Northwest corner of the Southwest Quarter of Section
9, Township 37 North, Range 2 East; thence West 200 feet; thence
in a Southwesterly direction 267 feet; thence East 264 feet to the
West line of Lombardy Drive; thence North along the West line of Lom-
bardy Drive 205 feet to the place of beginning.
Section 2
The following described real estate situated in the City of South Bend
be and the same is hereby rezoned as "Ctt Commercial Use District and ttE't
Height and Area District:
Beginning at a point 655 feet West and 391 feet South of the Northeast
corner of Section 8, Township 37 North, Range 2 Bast; thence East 110
feet; thence South 104 feet; thence East 200 feet; thence in a South-
easterly direction 267 feet; thence West 342 feet; thence in a North-
westerly and Northerly direction 367 feet to the place of beginning.
Section 3
The following described real estate situated in the City of South Bend
be and the same is hereby rezoned as "B" Residential Use District and "B"
Height and Area District:
Beginning at a point on the North line of Ford Street 232.56 feet
West of the Northwest intersection of said line with the Westerly
line of Lombardy Drive; thence West along the North line of Ford
Street 474 feet; thence Northwesterly 118 feet to the Southeast
corner of Tract B; thence Fast 546 feet to the Southwest corner
of Tract A; thence Southwesterly 139 feet to the place of beginning.
Section 4
This Ordinance shall be in effect from and after its passage and
legal publication*

Gentlemen:
The attached petition of Colpaert Realty Corporation
to rezone 20 acre parcel of land located in vicinity
of Ford Street and LombarffDrive was legally adver-
tised under date of July , 1955, and given public
hearing on August k, 1955•
This petition to rezone would, in effect remove
commercial land next to the Pierre Navarre School,
said land reverting to residential use, and increase
desirability of commercially zoned land by the addi-
tion of Tracts A and B.
The Board found that the general welfare would be
served by the granting of the petition, that a public
school serves residential land uses and is far better
located on a site which is surrounded by said resi-
dential uses, as opposed to commercial or industrial
uses. It was, therefore, moved, seconded, and carried
that the petition be favorably recommended to the
Council.

BEFORE THE.COMMON COUNCIL
PETITION OF COLPAERT REALTY CORPORATION
COLPAERT REALTY CORPORATION alleges:
1. Petitioner is the owner in fee simple of a tract of land in the City
of South Bend bounded by a line running as follows:
Beginning at the intersection of the South line of Western Avenue
and the 39est line of Lombardy Drive; thence South along the Westerly line
of Lombardy Drive to the North line of Ford Street; thence West along the
North line of Ford Street 1002 feet; thence Northwest and North on the
line approximately symmetrical to the Westerly line of Lombardy Drive a
distance of 912 feet to a point in the South line of Western Avenue
1207 feet West of the place of beginning; thence along the South line of
Western Avenue to the place of beginning.
2. Petitioner has long contemplated the development on said area of an
extensive, modern shopping center. To obtain the most practicable results aid
to afford a maximum of safety to the traveling public, it proposes and petitions
for changes in the zoning of three tracts, which, for convenience, are designated
"Tracts A. B and C ".
3. Tract A is bounded by a line running as follows:
Beginning at a point in the West line of Lombardy Drive 504 feet
South of the Northwest corner of the Southwest quarter of Section 9,
Township 37 North, Range 2 Fast; thence West 200 feet; thence in a Southwesterly
direction 267 feet; thence East 264 feet to the West line of Lombardy Drive;
thence North along the West line of Lombardy Drive 205 feet to the place of
beginning.
Tract A is presently zoned "B" Residential and "B" Height and Area. Petitioner
prays that Tract A be rezoned "C" Commercial and "E" Height and Area.

corner of Section 82 Township 37 North, Range 2 East; thence East 110 feet;
thence South 104 feet; thence East 200 feet; thence in a Southeasterly
direction 267 feet; thence West 342 feet; thence in a Northwesterly and
Northerly direction 367 feet to the place of beginning.
Tract B is presently zoned "B" Residential and 'B" Height and Area. Petitioner
prays that Tract B be rezoned "C" Commercial and "E" Height and Area.
5. Tract C is bounded by a line running as follows:
Beginning at a point on the North line of Ford Street 232.56 feet
West of the Northwest intersection of said line with the Westerly line
of Lombardy Drive; thence West along the North line of Ford Street 474
feet; thence Northwesterly 118 feet to the Southeast corner of Tract B;

Tract C is presently zoned "C" Commercial and "E" Height and Area. Petitioner
prays that Tract C be rezoned to "B" Residential and "B" Height and Area.
6. Attached hereto and filed herewith is a map showing the areas described
in this petition and also the Pierre Navarre School.
7. Also, attached hereto and filed herewith is a proposed amendment of
the Zoning Ordinance, the adoption of which is sought by this petition.
WHEREFORE, petitioner prays:
1. That the Council refer this petition and the proposed amendment to
the Plan Commission for hearing and recommendations.
2. Upon receipt of a favorable report from the Plan Commission, that the
Council adopt such proposed amending ordinance.
