AN ORDINANCE AMENDING ORDINANCE NUMBER 3702

Be it ordained by the Common Council of the City
of South Bend, Indiana;
Section 1
That the property situate in the City of South Bend,
Indiana, and described as follows, to -wit;
A parcel of land in the Northwest One- Quarter
(1/4) of Section Thirty (30), Township Thirty -
seven (37) North, Range Three (3) East, in
Center Township, St. Joseph County, Indiana,
more particularly described as follows:
Beginning at a point that is on the South
line of the Northwest One- Quarter (1/4) of
Section Thirty (30), Township Thirty -seven
(37) North, Range Three (3) East, and a dis-
tance of One Thousand Ninety -seven and Nine
Tenths (1,097.9) feet East of the Southwest
corner of the Northwest Quarter (1/4) of
Section Thirty (30), thence North, at an
angle of Ninety Degrees (900) to the left
a distance of Forty (40) feet, to the Point
of Curvature of a curve to the left, having
a radius of Three Hundred Ninety and Seventy -
six Hundredths (390.76) feet and an interior
angle of Twenty (20 Degrees, Fifty -four (54)
Minutes and Thirty 30) Seconds, thence along
said curve to the lefty an arc distance of
One Hundred Forty -two and Six Tenths (142.6)
feet to the point of Tangency of said curve,
thence along the tangent of said curve pro-
duced, a distance of Four Hundred Sixty -six
and Eighty -five Hundredths (466.85) feet,
thence Westerly, at an ogle of Ninety (90)
Degrees to the left, a distance of Thirty -
eight and Thirty -three Hundredths (38.33)
feet, thence Southerly, at an angle of Ninety
(90) Degrees to the left a distance of Four
Hundred Four and Ninety -eight Hundredths
(404.98 feet, thence South, at an angle of
Twenty (20) Degrees Fifty -four (54) Minutes
and Thirty (30) Secondsto the right a dis-
tance of One Hundred Fifty -nine and Seventy -
nine Hundredths (159.79) feet to a point on
the South line of the Northwest One- Quarter
(1/4) of Section Thirty (30), Township Thirty -
seven (37) North, Range Three (3) East, thence
East along the South line of the Northwest
One- Quarter (1/4) of Section Thirty (30) a
distance of Seventy -two and Sixty -four Hun-
dredths (72.64) feet to the point of beginning,
be rezoned from "C" Commercial Use District and "D" Height
and Area District to "B" Residence Use District and "B"
Height and Area District.
Section 2
This ordinance shall be in full force and effect
from and after its passage and legal publication by the
Common Council of the City of South Bend.

Gentlemen:
The petition of First Bank and Trust Company
of South Bend to amend the district map of
zoning ordinance, as it applies to land in
the Revised Plat of Broadmoor Third Addition,
from "C" Commerci *1 and 11 1
te 1 Height and Area
District to "B" and "B" Height and
Area District, said land lying West of
Catherwood Drive between Ireland Road and
Alpine Drive, was legally advertised under
date of May 27, '55, and given public hearing,
before the Planning Commission, held under
date of June 2, 155.
The Commission found that surrounding property
is predominantly used and zoned residentially
and that residential use is most appropriate
for subject property.
Above petition is, therefore, favorably recom-
mended.
