AN ORDINANCE AMENDING ORDINANCE
NUMBER 3702 COMMONLY HNOWN AS THE
ZONING ORDINANCE OF THE CITY OF
SOUTH BEND, INDIANA
BE IT ORDAINED by the Common Council of the City of
South Bend, Indiana:
SECTION 1, Ordinance Number 3702, being a zoning ordinance
of the City of South Bend, Indiana, be, and the same hereby is,
amended so that the zoning classification of the following real
estate in the City of South Bend, Indiana, to -wit:
Lots Numbered Twenty (ZO) and Twenty -one (Z1)
as shown on the recorded Plat of Beyer's
Second Addition to the City of South Bend,
Indiana, and the alley extending in an easterly
and westerly direction immediately adjacent to
and on the south rear of said lots which alley
has heretofore been vacated by legal process
and operation of law
be, and the same are hereby, changed to and zoned as "D" light
industrial use district and "F" height and area district.
SECTION Z. This ordinance shall be in full force and
effect from and after its passage by the Common Council, approval
by the Mayor and legal publication.

Bend, to rezone lots No. 20 and 21 in Beyer's Second
Addition from C commercial and E height and area districts

was given legal notice under date of March 24, 1954, aryl
public hearing before your City Planning Commission under
date of April 1, 1954. This property is located on the
southwest corner of Mishawaka Avenue and Louise Street.
This petition is recommended favorably.

Second Addition from "C" Commercial Use District and
"S" Height aid Area Distrio4o "D" Light Industrial
Use District and "F" Height and Area District.
Councilman Niezgodski made a motion that the petition
be referred to the City Plan Commission. Councilman
Bestle seconded the motion. Motion carried.

PETITION TO RE -ZONE LAND
TO THE COMMON COUNCIL OF THE CITY OF SOUTH BEND, INDIANA
The Petitioner, National Milk Company, Inc., an Indiana
corporation, would represent and show to the Honorable Common
Council of the City of South Bend, Indiana, that said corpora-
tion is the legal owner of the following described real estate
situate in the City of South Bend, County of St. Joseph, State
of Indiana, to -witt
Lots Numbered Twenty (2O) and Twenty -one
(21) as shown on the recorded Plat of
Beyer *s Second Addition to the City of
South Bend, Indiana.
That all of said real estate is situate on the south side
of Mishawaka Avenue and immediately adjacent to and on the east
side of the Grants Trunk Railway right of way. Your petitioner
would further represent and show to this Honorable Body that at
the time of the recording of the plat containing said lots there
was an alley provided on the south rear of said lots extending
in a general easterly and westerly direction, said alley being
south of and parallel to said Mishawaka Avenue. That said alley
has heretofore been vacated by legal process and operation of
law and the fee simple title thereto has by operation of law
reverted to the petitioner.
Your petitioner would further represent and show that
Lots Numbered Twenty (2O) and Twenty -one (21) as shown on the
recorded Plat of Beyer's Second ,addition to the City of South
Bend, heretofore described in this petition, are now zoned "C"
Commercial Use District and "E" Height and Area District.
Your petitioner further represents that all of the land
west of Louise Street and south of the aforesaid vacated alley
to the St. Joseph River and east of the Grand Trunk Railroad

right of way is presently zoned "D" Light Industrial Use Dis-
trict and "E" Height and Area District. That the real estate
Immediately adjacent to the south of said vacated alley is owned
by said petitioner and that there is located thereon a Dairy
Plant and Milk Distributing station,
Your petitioner further represents that the one -story
buildings located on said Lots Numbered Twenty (20) and Twenty -
one (21) as shown on the recorded plat of Beyer's Second Addition
to the City of South Bend are now used for salesrooms. That it
is the purpose of your petitioner to expand its present operations
In that it proposes to erect a two (2) story building on said
lots with its business offices on the second floor thereof and
to install on the first floor a laboratory for testing and
grading milk and to construct stainless steel storage tanks
for receiving raw milk and storing the same for further process-
ing in its main plant,
Your petitioner desires to have all of said tract in the
same zoning and the same use district and height and area dis-
trict, namely, "D" light industrial use district and "F" height
and area district*
Your petitioner would further state that the granting of
this petition as prayed for would not impair the value of the
properties in the immediate vicinity or in any way endanger the
health, morals or general welfare of the community, but would in-
crease the processing and distribution of a food product resulting
in a general benefit to an increased population.
WHEREFORE, your petitioner respectfully prays that said
above described real estate be changed to the zoning and the
use and height and area districts prayed for above,
