AN ORDINANCE 1WENDING ORDINANCE
NUMBER 3702 COMMONLY KNOWN AS THE
ZONING ORDINANCE OF THE CITY OF
SOUTH BEND, INDIANA
BE IT ORDAINED by the Common Council of the City of
South Bend, Indiana:
SECTION 1. Ordinance Number 3702, being a zoning ordi-
nance of the City of South Bend, Indiana, be, and the same
hereby is, amended so that the zoning classification of the
following real estate in the City of South Bend, Indiana, to wit:
Lots Numbered Fifty -seven (57) through
Seventy -six (76), inclusive, in the
Recorded Plat of Oak Park Second Addition,
an Addition to the City of South Bend,.
Indiana
be, and the same are hereby, changed to and zoned as "B" Resi-
dential District and "E" Height and Area District,
SECTION 2. This ordinance shall be in full force and
effect from and after its passage by the Common Council, approval
by the Mayor and legal publication.

Gentlemen:
Petition of Bishop John F. Noll by Rev.
A. J. Wibbert to change the zoning of Lots No. 57
through 76 of Oak Park Secord Addition, which lots
comprise.the entire block bounded by Miami, Dubail,
Dale, and Dayton Streets, from A and C use district
to B use district retaining the existing L height
and area district, was given legal notice under date
of February 19, 1954, and public hearing before the
City Planning Commission under date of March 4, 1954.
This change is recommended as petitioned for.

The undersined petitioner would represent and show to the
Honorable Cordmon Council of the City of South Bend, Indiana,
that he is the legal owner of the folloWing described real estate
situate in tike City of South Bend, County of 36• Joseph, State

All of that real estate idnich consists of one (1) square
block in said City and County bounded on t1ne mast by I.Iiami Street
on the worth by Dubail Avenue, on the ?.est by Dale Avenue and
on the South by Dayton Street, all of which said. square block is
more - particularly and legally described as follows:

herein above set forth that there vTere various and divers alleys

block and i,hat all of said alleys have heretofore been vacated b,
legal ;rocess and the fee title thereto has by operation of lawn
reverted to the undersigned petitioner.
Your petitioner would further represent and show that Lots
Numbered Nifty Seven (57) through sixty four (64) inclusive in
O -k park Second Addition heretofore described in this petition,
are now zoned "C" Commercial as to usage and "E" .Height and Area
as to Height and r:rea 'District.
Your petitioner would further represent and show that all
the rest and remainder of said real estate heretofore described
with the e-cention of the alleys referred to, is zoned "A"
Residential as to usage and "A" Height and Area as to Height and
F_rea District.

P:Iatthews Homan Cacholi.c Church and School and buildings incident
to the operation of said Church and School.
Your petitioner now prays 'ahe Common Council of the City
of South Bend that Lots Lumbered :Fifty -Seven (57) throw Sixty
Four (64) inclusive in said plat be changed from their present
zoning of "C" Commercial to the zoning classification of "B"
Residential District and that the "E" height and__.rea District
now -orovided for said lots remain unchanged, and your petitioner
;rould i °urther pray the Common Council of the City of South Bend
that all of the rest and remainder of the real estate herein
described including the vacated alleys horeinbefore referred to,
be changed from the present zoning of "A" Residential District
and "A" Height and Area District to "B" Residence and "E" Height
and Area District for the following reasons:
1. hat it is the purpose of the undersigned, to cause a

building being erected for dwelling purposes, is not permitted.

be erected on a portion of the real estate fronting on Dale
Avenue, v,Th.ich said use will be an accessory building; incident to
