Be it ordained by the Common Council of the City of
South Benda Indiana:
Section 1: Ordinance No. 37020 being a Zoning Or-
dinance in the City of South Benda Indiana. Bea and
the same hereby is amended so that the Zoning olassi-
fication of the followinE described real estate in the
City of South Benda Indiana be and the same is her ^b�I
change:i to "A" Use and "A" HeiPht and "Area Districsso'
Lots 4 through 9 inclusive and 11 through 12 inclusive
of Elwood Avenue Addition, and lots 1 through b in-
clusive and 47 c' ^rough Jt9 inclusive of Elwood Park
Addition to the City of South Benda County of St. Jo-
seph, State of Indiana.
Section 2: This Ordinance shall be in full force and
affect from and after its passage by the Common Council,
approval by the Mayor and legal publication.

Gentlemen:
Petition of Joseph S. Vance, 2109 Elwood Avenue,
et al, being petition to rezone Lots 1, 2, 3, 4, 5, 61 27,
48, and 49 of Elwood Park Addition; and Lots 1, 2, 3 of
Huey Heights Second Addition, Lots 26, 27, and 28 proposed;
and Lots 4 through 12 inclusive of Elwood Avenue Addition,
and more particularly located for this purpose on Elwood
Avenue between Johnson and Huey from C commercial and D
height and area district to residential use and residential
height and area district. This petition was given public
hearing under date of December 3, 1953, and petition is
recommended by amending same as follows:
Lots 4 through 9 inclusive and 11 througi 12
inclusive of Elwood Avenue Addition and Lots 1
through 6 and 47 through 49 inclusive of Elwood
Park Addition from C commercial and D height and
area district to A residential and A height and
area district.

PETITION TO RE -ZONE LAND
To The Common Council of The
City of South Bend, Indiana
The Undersigned Petitioners Would Represent and show to the Honorable
Body that it is the owners of the following described real estate situated in
the city of South Bend Indiana, County of Saint Joseph, State of Indiana.
To Wit
Lot Numbers 1, 2p, 45p - 47, 48,49.3_,.2-3-1--of Elwood Park Addition and Lots,
3, 2, and 1 of Huey Heights 2nd Addition Lots 28, 27, and 26 prepos`ed and lots
4, 51617, 80 9, 10, 11, and 12 of Elwood Ave. Addition as shown in the county
recorders plans, and more particularly located for this purpose on Elwood
Ave. between Johnson St. and Huey.
Your Petitioners would further represent, and show that the said above
described real estate is now zoned commercial, and your petitioners is
hereby petitioning your Honorable Body to change such zoning district to
residential area.

Dear Sir:
On December 30, 1953 I received your letter dated Decem-
ber 14, 1953 pertaining to the petition of Mr. Joseph
Vance requesting the Council to change the zone classifi-
cation on all lots facing Elwood Avenue on both sides of
the street between Huey Street and Johnson Street from
its present commercial zoning classification to residen-
tial.
I was unable to attend the public hearing on December 10,
1953 but did sign the petition of Mr. Vance. ''he doubt
in my mind is why it took 15 days from the date of the
letter to going into the mails post marked December 29,
1953•
My views on why the 3 lots at the northeast intersection
of Huey and Elwood Streets and the 3 unplatted lots (from
the north -south alley east to Johnson Street) at the south-
west corner of Johnson and Elwood Streets should be a resi-
dential zone are as follows.
At this time there are 2 grocery stores in the 2 block area
between Huey and Johnson Streets on Elwood and also 6 more
grocery stores conveniently located within a radius of 2 to
4 blocks from the afore mentioned avenue. 74here are 2 drug
stores, 3 cleaning establishments, 3 hardware stores, 3 bar-
ber shops, 7 automobile service stations, 1 tavern, 1
variety store and 2 radio - television repair stores within a
radius of 8 blocks of the afore mentioned avenue.
There is convenient bus service going north on O'Brien
Street and south on College Street and going east and west
on Lincoln Way. This bus service would take anyone to any
of these business establishments or downtown within a matter
of a few minutes if they are not able to walk or own an
automobile.
The narrowness of Elwood Avenue between Huey and Johnson
Streets would only lead to more traffic hazards to our pro-
perty and children in this area. This avenue is used as a
short -cut by the Bendix, Oliver and Studebaker employees
which forces me to bring my own children into the house or
yard because of the traffic at this time.

City Hall
Several rats and mice have been discovered in the neigh-
borhood in the past 3 to A years that the 2 grocery stores
have been operating. To add any more commercial buildings
would only add to traffic hazards, health hazards and
juvenile delinquency.
The front of the 2 stores now are kept fairly neat, but
the back and sides are not kept neat to the extent that the
grass is not mowed, papers are strewed all over the neigh-
borhood which only depreciates the value of my property as
well as the other residents in the neighborhood.
I would go along with the idea if this property was utilized
as an apartment house but I would not want to see any other
commercial buildings going up such as a drug store, grocery
store or a tavern which in all probability would be erected.
I was informed when I purchased my property that it was a
residential zone and if it was ever changed from residential
to commercial I was never informed of such action as I have
lived in this neighborhood since the house was erected in
1946•
I am therefore hoping that the City Planning Commission will
be considerate enough of the property owners to re -zone this
district from commercial to residential.
