BE IT ORDAINED by the Common Council of the City of South Bend, Indiana: Section 1. That Ordinance No. 3702 adopted by the Common Council of the City of South Bend, Indiana, on the 13th day of June, 1949, and commonly known as the Zoning Ordinance, be and the same is hereby amended as follows, to -wit: That the zoning of the following described real estate situate in the City of South Bend, Indiana, and described as follows, to-""it: Commencing at the intersection of Bendix Drive and Lincoln 'flay West; thence Northwesterly along Lincoln Way West to a point 712 feet West of the center line of Bendix Drive; thence North to the center line of Elwood Avenue produced East; thence East to the West line of Bendix Drive; thence South to the place of beginning, containing 11.88 acres, more or less, e changed from "A" Residential and "All Height and Area and "C" Commercial and "D" Height and Area to "C" Commercial and "E" Height and Area District. HUFF DIRECTOR OF PLANNING CITY OF SOUTH BEND SOUTH BEND, INDIANA CITY PLAN COMMISSION January 11, 195?+ To: Common Council, City of South Bend Gentlemen: Petition of Louis Gruszynski and Pelagia Kaniewski for change of zoning of an unplatted tract of land containing 11.88 acres, more or less, fronting on the north side of Lincoln Way West and exterdin g 712 feet west from the centerline of Beniix Drive and extending north to the center line of Elwood Avenue produced. This area is now zoned A residence and A height and area dis- tricts excepting a portion approximately 150 feet on Lin- coln Way West and 150 feet on Bendix Drive which is zoned C commercial and D height and area districts. Petitioners ask to have the entire area made C commercial and E height and area districts. This change is recommended as petitioned for, for the reason that land area involved consisting of 11.88 acres, more or less, is sufficient area classified as a consolidated shopping district and eventually to adequately serve the community in an area where no such consolidated shopping districts exist. The undersigned petitioners would represent and show to Honorable Body that they are the olners of the following descri real estate situate in the City of South Bend, County of St.Jos State of Indiana, to -wit; Commencing at the intersection of Bendix Drive and Lincoln Viay West; thence Northwesterly along Lincoln Way ;west to a point 712 feet :Jest of the center line ofr.endi,? Said above described real estate is now vacant and petitioners herein have entered into an option to sell a portion of the same approximately Two Hundred (200) foot frontage on Lincoln Way 17ost with a depth of Two Hundred fifty (250) feet of Bendix Drive, to Charles 1.'. Upham, who desires to erect a store build ing.thereon with sufficient parking facilities upon the same to care for his clientele, 2. The property located on the South side of Lincoln Way and across the street from the above described real estate is zoned Commercial from Iowa Street on the ? "lest to Goodland Street on the East and further the property located on the East side of Bendix Drive and on the North side of Lincoln 'ljay is zoned Commercial from Bendix Drive to Goodland Street on the Last, therefore, the granting of this petition would be a continuation of the general trend concerning Lincoln Flay ,,°jest, from a zoning standpoint, to one of Commercial use. 4.
