'�44�3 AN ORDINANCE AUTHORIZING THE SALE OF VACANT PROPERTY ON LINCOLN WAY EAST BELONGING TO THE WATER WORKS DEPARTMENT OF THE CIVIL CITY OF SOUTH BEND$ INDIANA BE IT ORDAINED by the Common Council of the Civil City of South Bend, Indiana: SECTION I: The vacant property on Lincolnway East in the City of South Bend belonging to the Water Works Department of the Civil City of South Bend, Indiana, and more particularly described as follows: Beginning on the North line of Lincoln Way East at a point where the West line of Lot 26 South Bend Mfg. Cots Addition produced southerly inter- sects the Northerly line of said Lincoln Way East, as now located, which point is 13.05 ft, from the original South West corner of said Lot 26; thence North 60 degrees West along the present northerly line of said Lincoln Way East a distance of 64.86 ft.; thence North 30 degrees East, at right angles to the northerly line of said Lincoln Way East a distance of 95.37 ft. to the intersection of the westerly line of Lot 26 said South Bend Mfg. Cots Addition; thence South 18 degrees West along the Westerly line of said Lot 26 a distance of 34.54 ft. to angle in said lot line; thence South 30 de- grees West along the westerly line of said lot 26 a distance of 81.87 ft. to the place of beginning, all in the City of South Bend, St. Joseph County Indiana, subject to an existing lease and subject al o t a er etua easement for public utilities b low he ura a hereof' is hereby oere� sold in accordance with the provisions of this ordinance. SECTION II: The Judge of the Circuit Court of St. Joseph County, Indiana is requested to appoint three disinterested freeholders of the City of South Bend, Indiana to appraise said property at its fair cash market value. SECTION III: After such appraisal the proper legal officers of said city are authorized to sell, assign, transfer, convey and set over by proper legal instrument to any purchaser thereof the real estate herein above described for not less than the full appraised value thereof, as reported by the appraisers appointed by the Judge of the St. Joseph Circuit Court and the Mayor is hereby authorized to execute and deliver to any purchaser or purchasers thereof, upon the payment of the appraised value thereof, a good and sufficient deed of conveyance, and this shall be sufficient authority to him in said premises. SECTION IV: This ordinance shall be in full force and effect from and after its adoption by the Common Council and approval by the Mayor.
