AN ORDINANCE MENDING ORDINANCE
NUMBER 3702 COMMONLY KNOWN AS THE
ZONING ORDINANCE OF THE CITY OF
SOUTH BEND. INDIANA
BE IT ORDAINED by the Common Council of the City of
South Bend, Indiana: That,
SECTION 1. Ordinance Number 3702, being a zoning ordi-
nance of the City of South Bend, Indiana, be, and the same
hereby is, amended so that the zoning classification of the
following real estate in the City of South Bend, Indiana,
to -wit:
Beginning at the Northeast corner of the South
one -half (z) of the Southwest quarter (�) of
Section Thirty-five (35), Township Thirty -eight
(38) North, Range Two (2) East in St. Joseph
County, Indiana; thence South four hundred
ninety -two (492) feet; thence West one hundred
seventy -six (176) -feet; thence South eight
hundred thirty (830) feet to the South Line of
said section; thence East to the St. Joseph
River; thence down stream along the edge of the
River to a point due East of the point of begin-
ning; thence West to the place of beginning,
be, and the same is hereby, changed to and zoned as "D"
light industrial use district and "D" height and area dis-
trict.
SECTION 2. This ordinance shall be in full force and
effect from and after its passage by the Common Council, approve
by the Mayor of the City of South Bend, Indiana, and legal
publication.

Gentlemen:
The petition of Lock Joint Tube Company to rezone
approximately 19 acres in the Northwest section
of the city from "B" use District and "B" Height
and Area District to "D" Use District and "D"
Height and Area having been legally advertised
under date of March 81 1955, was given public
hearing under date of March 17, 19551 At a special
meeting held under date of March 232 1955, it was
moved, seconded, and carried that the petition be
favorably recommended.

PETITION TO RE -ZONE LAND
TO THE COMMON COUNCIL OF THE CITY OF SOUTH BEND, INDIANA:
The undersigned petitioner would represent and show
to the Honorable Common Council of the City of South Bend, Indiana,
that said corporation is the legal owner of the following described
real estate situate in the City of South Bend, St. Joseph County,
State of Indiana, to -wit:
Beginning at the Northeast corner of the South
one -half (g) of the Southwest quarter (j) of
Section Thirty -five (35), Township Thirty -eight
(38) North, Range 2 East in St. Joseph County,
Indiana; thence South four hundred ninety -two
(492) feet; thence West one hundred seventy -six
(176) feet; thence south eight hundred thirty
(830) feet to the south line of said section;
thence east to the St. Joseph River; thence down
stream along the edge of the river to a point due
east of the point of beginning; thence west to the
place of beginning.
That all of said real estate prior to its purchase
by thepetitioner was used and occupied by a brick manufacturing
company long abandoned and was of industrial use. That your
petitioner owned and had title to said real estate, consisting
of approximately nineteen (19) acres, prior to the enactment and
passage of the original Zoning Ordinance of the City of South
Bend, Indiana, Ordinance Number 2331, adopted June 25, 1923.
That pursuant to said ordinance all of said real estate
was zoned "Q" Residential as to usage and "g" Height and Area as
to Height and Area District, excepting that the south Three Hun-
dred Twenty -two (322) feet of said real estate was zoned "D"
Light Industrial District under said Zoning Ordinance.
That it is necessary and expedient that petitioner ex-
pand its present operations and extend its buildings now located
on that parcel of land zoned "D" Light Industrial :District to
keep apace with its competition and more particularly to install
sliting machines in preparing its steel tubing for manufacture.

Your petitioner desires to have all of said tract of
real estate in the same zoning and the same use district and height
and area district, namely, "D" Light Industrial Use District and
Height and Area District.
Your petitioner would further state that the granting
of this petition as prayed for would not impair the value of the
properties in the immediate vicinity or in any way endanger the
health, morals, or general welfare-of the community. That said
land was purchased by the founders of said company for the purpose
of expanding the industry prior to the passage of any zoning ordi-
nance and when the area had been an industrial district.
WHEREFORE, your petitioner respectfully prays that
said above described real estate be changed to the zoning and the
use and height and area districts prayed for above.
