AN ORDINANCE AUTHORIZING THE SALE OF
REAL PROPERTY OWNED BY THE CITY OF
SOUTH BEND, INDIANA
BE IT ORDAINED by the Common Council of the Civil
City of South.Bend, Indiana:
SECTION I: That the following items of real property be
appraised and sold by the Board of Public Works and Safety
for not less than the full appraised value thereof:
PARCEL I
Description of a parcel of land located in
the Northwest One- Quarter of Section Twenty -six
(26), Township Thirty -eight (T38N) North, Range
Two (R2E) East, St. Joseph County, Indiana,
identified as Parcel I and further described as
follows: Commencing at a point three thousand
eight hundred nineteen (3,8191) feet East of the
Southwest corner of the Southeast One- Quarter
of Section Twenty -two (22), Township Thirty -
eight (T38N) North, Range Two (R2E) East, and
further described as being located on the North
line of Section Twenty -six (26).sixty -five and
twenty -nine hundredths (65.291) feet East of
the centerline of Riverside Drive; said point
being an iron pipe driven in the ground, thence
running westerly along the North Line of Section
Twenty -six (26) a distance of one hundred fifteen
and sixty -one hundredths (115.611) feet, thence
turning a deflection angle to the left of
ninety -six degrees, twenty -eight minutes
(960 -281) and running South six degrees, twenty -
eight minutes (S 60 -281 E) East a distance of forty
and twenty -six hundredths (}0.261) feet to the
place of beginning, thence continuing along the
West property line of Riverside Drive and running
South six degrees, twenty -eight minutes (S 60 -281 E)
East a distance of three hundred fourteen and
nine hundredths (314.901) feet, -thence running
South eighty -nine degrees, forty -eight minutes and
fifty -four seconds (S 890 - 481 -54" W) West a
distance of three hundred thirty -four and twenty -
five hundredths (334.251) feet, thence running
North zero degrees sixteen minutes (N 00 -161 W)
West a distance of three hundred thirteen and
twenty -four hundredths (313.21.1) feet, thence
running due East forty (401) feet South of and
parallel to the North Line of Section Twenty -six
(26) a distance of three hundred and thirty -
three hundredths (300.331) feet, to the place of
beginning. Containing 24258 acres.
PARCEL II
Description of a parcel of land located in
the Northwest One Quarter (1/4) of Section
Twenty -six (26), Township Thirty -eight (T 38 N)
North, Range Two (R 2 E) East, St. Joseph County,
Indiana, noted as Parcel II, and further de-
scribed as follows: Commencing at a point
three thousand eight hundred nineteen (3,8191)
feet East of the Southwest corner of the Southeast
One Quarter (1/4) of Section Twenty -two (22),
Township Thirty -eight (T 38 N) North, Range Two
(R 2 E) East, and further described as being
located on the North line of Section Twenty -six
(26) sixty -five and twenty -nine hundredths
(65.291) feet East of the centerline of Riverside
Drive; -said point being an iron pipe driven in
the ground; thence continuing East ten and
nineteen hundredths (10.191) feet along the
North line of Section Twenty -six (26), thence
turning a deflection angle of eighty -three
degrees, thirty -tiro minutes (83 0321) right and
running South six degrees, twenty -eight minutes
(S 60281E) East, a distance of twenty -one and
ninety -four hundredths (21.9_') feet to the
point of beginning; thence running North eighty -
nine degrees, forty -eight minutes and fifty -four

easterly from the centerline of Riverside Drive,
measured at a right angle to the centerline of
Riverside Drive, a distance of three hundred
forty and four hundredths (310.041) feet to the
place of beginning. Containing 5.067 acres.
PARCEL III
Description of a parcel of land located in
the Northwest One- Quarter of Section Twenty -six
(26), Township Thirty -eight (T38N)North, Range
Two (R2E) East, St. Joseph County, Indiana,
identified as Parcel III and further described
as follows: Commencing at a point three thousand
eight hundred nineteen (3,8191) feet East of the
Southwest corner of the Southeast One- Quarter
of Section Twenty -two (22), Township Thirty -
eight (T38N) North, Range Two (R2E) East, and
further described as being located on the North
line of Section Twenty -six (26) sixty -five and
twenty -nine hundredths (65.291) feet East of
the centerline of Riverside Drive; said point
being an iron pipe driven in the ground, thence
running easterly along the North line of
Section Twenty -six (26) a distance of ten and
nineteen hundredths (10.191) feet, thence
running South six degrees twenty -eight minutes
(S 60281 E) East a distance of three hundred
fifty -three and ninety -four hundredths (353.941)
feet, thence running South eighty -nine degrees
forty -eight minutes and fifty -four seconds
(S 8904815411 W) West a distance of twenty -five
and sixteen hundredths (25.161) feet to the
point of beginning, thence running South six
degrees twenty -eight minutes (S 60281 E) East
along the East property line of Riverside Drive
a distance of one hundred and six - tenths (100,601)
feet, thence running South eighty -nine degrees
forty -eight minutes and fifty -four seconds
(S 89048154" W) West a distance of Four hundred
forty -five and seventy -five hundredths (445.751)
feet, thence North zero degrees and sixteen -
minutes (N 00161 W) West a distance of One
hundred (100.001) feet, thence north Eighty -
nine degrees forty -eight minutes and fifty -
four seconds (N 89048154" E) East a distance of
Four hundred thirty -four and eighty -nine
hundredths (434.891) feet to the place of be-
ginning. Containing 1.0108 acres.
PARCEL IV
A right of construction and aerial easement
for the support of bridge structures and an
underground easement for drainage carried
northerly and easterly across the following described
parcel of land: Description of a parcel of land
located in the Northwest One- Quarter (1 /4) of
Section Twenty -six (26), Township Thirty -eight
(T 38 N) North, Range Two (R 2 E) East, St.
Joseph County, Indiana, identified as Parcel IV,
and further described as follows: Commencing
at a point three thousand eight hundred nineteen
(318191) feet East of the Southwest corner of
the Southeast One Quarter of Section Twenty -two
(22), Township Thirty -eight (T 38 N) North,
Range Two (R 2 E) East, and further described
as being located on the North line of Section
Twenty -six (26) sixty -five and twenty -nine
hundredths (65.291) feet East of the centerline
of Riverside Drive; said point being an iron
pipe driven in the ground; thence continuing
East ten and nineteen hundredths (10.191) feet;
thence running South six degrees, twenty -eight
minutes (S 60281 E) East, parallel to and
seventy -five (751) feet easterly from the
centerline of Riverside Drive, measured at a
right angle to Riverside Drive, a distance of
twenty -one and ninety -four hundredths (21.941)
feet to the point of beginning, thence continuing
southerly along the same line a distance of
three hundred thirty -two (332.001) feet; thence
running South eighty -nine degrees, forty -eight
minutes and fifty -four seconds (S 89048154" W)
West, a distance of one hundred twenty -five
and eight tenths (125.801) feet, thence running
North six degrees, twenty -eight minutes
(N 60281 W) West along the West property line of
Riverside Drive, a distance of three hundred
thirty -two (332.001) feet; thence running North
eighty -nine degrees, forty -eight minutes and
fifty -four seconds (N 89048'54" E) East, a
distance of one hundred twenty -five and eight
tenths (125.80') feet to the place of beginning.
Containing 0.9527 acres.
SECTION II: That the Judge of the St. Joseph Circuit Court
be requested to appoint three (3) disinterested freeholders
of the City of South Bend, Indiana, to appraise said
property hereinabove described.
SECTION III: That the Board of Public Works and Safety,
subject to such terms and conditions as said Board shall
determine, shall sell and deliver said property to any
purchaser or purchasers thereof upon the payment of the
purchase price in full but for not less than the full
appraised value thereof.
SECTION IV: That this Ordinance shall be in full force
and effect from and after its adoption by the Common
Council and its approval by the Mayor.

Come now the undersigned appraisers, having been
appointed by the Honorable Elmer J. Peak, Judge of the
St. Joseph Circuit Court, and after having been duly sworn
upon their oaths to honestly and impartially appraise the
real estate described in the Courtfs Order of Appointment,
do now report that after due examination of the premises,
consisting of unimproved acreage in the Northwest One- quarter
of Section 26, Township 38 North, Range 2 East in
St. Joseph County, Indiana, that we are of the opinion that
said real estate has a fair cash market value of
§400.00 per acre.
