AN ORDINANCE AMENDING AND SUPPLEMENTING ORDINANCE
NO. 3702, COMMONLY KNOWN AS THE ZONING ORDINANCE
OF THE CITY OF SOUTH BEND
BE IT ORDAINED BY THE COMMON COUNCIL OF THE CITY OF SOUTH BEND:
Section 1. Ordinance No. 3702, as amended, being a
zoning ordinance of the City of South Bend, Indiana, be and the
same is hereby amended and supplemented so that the zoning
classification of the following described real estate located
in the City of South Bend, St. Joseph County and the State of
Indiana, to -wit:
Lots "G -2 ", "F -2" and "E -2" as shown on
the recorded Plat of Wenger and Krieghbaum's
Vistula Avenue Addition, more fully described
as beginning on the west edge of the St.
Joseph River on the line between lots "G -2"
and "H -2" as shown on the recorded Plat of
Wenger and Krieghbaum's Vistula Avenue Addi-
tion, thence Southwest on the line between
said lots "G -2" and "H -2 "; to Lincoln Way
East, thence Northwest on the Easterly line
of Lincoln Way East 136.7 feet, thence
Northeast parallel to the line between said
Lots "G -2" and "H -2" 30 feet; thence North-
west parallel to Lincoln Way East 50 feet;
thence Northeast parallel to the line between
said lots "G -2" and "H -211, to the St. Joseph
River, thence Southeast along said river,
to the place of beginning,
be and the same is hereby changed from a public park classification
to a "C" Commerfial Use District and a "C" Height and Area District.
Section 2. This ordinance shall be in full force and
effect from and after its passage by the Common Council, approval
by the Mayor and legal publication.

Gentlemen:
The attached petition of Veterans of Foreign Wars
Post No. 1167 to rezone lots G-2, F -2, and E -2 of
Wenger & Krieghbaum's Vistula Avenue Addition,
which land lies on the Northwest side of L. W. W.
between Sample and Grand Trunk Railroad to "C"
Commercial and "C" Height and Area District, was
legally advertised on January 24, 1955, and given
public hearing by the City Planning Commission on
February 3, 1955. The petition to rezone was
favorably recommended.

PETITION TO ZONE REAL ESTATE

The undersigned petitioner would respectfully show to
your honorable body that it is the owner of the following
real estate located in the City of South Bend, St. Joseph County
in the State of Indiana, to -wit:
Lots "Q -2 ", "F -2" and "E -2" as shown on the
recorded Plat of Wenger and Krieghbaum's
Vistula Avenue Addition, more fully described
as beginning on the west edge of the St.
Joseph River on the line between lots "Q -?"
and 'H -2" as shown on the recorded Plat of.
Wenger and Krieghbaum's Vistula Avenue Addi-
tion, thence Southwest on the line between
said lots "G -2" and "H -2 ", to Lincoln Way
East, thence Northwest on the Easterly line
of Lincoln Way East 136.7 feet, thence
Northeast parallel to the line between said
Lots "G -2" and "H -2" 30 feet; thence North-
west parallel to Lincoln Way East 50 feet;
thence Northeast parallel tothe line between
said lots "Q -2" and "H -2 ", to the St. Joseph
River, thence Southeast along said river,
to the place of beginning.
The undersigned would further show that said real estate
presently has no classification; that prior to the 13th day of
August, 1951, it was South Bend public park land; that on said dal
it was conveyed to the undersigned by George A. Schock, Mayor of
the City of South Bend, and that to date no zoning classification
has been given the above described real estate.
Your petitioner would show that the land lying immedia
West of the above described real estate is zoned D Light Industr
that the land lying immediately East of the above described real
estate is in a C Commercial district; that the land lying across
the street and immediately adjacent thereto is zoned as Light
Industrial or has no zoning classification at all by reason of
being public park lands.
Your petitioner would show that it operates a Veterans of
Foreign Wars club rooms on the property lying immediately East of
the above described real estate; that the petitioner desires to
erect an addition to its building, which addition is to lle upon
the above described real estate and which addition will house
additional club rooms, restaurant facilities and possibly several
bowling alleys; this petitioner would further show that it will
erect a building upon said real estate of modern architectural
design and that the erection of such building will enhance the
value of other properties in the area and will not and cannot
work a detriment to the surrounding property owners, nor will the
said re- zoning be, in any way, to the disadvantage of anyone
directly or indirectly concerned.
WHEREFORE, -your petitioner respectfully requests your
honorable body that Ordinance No. 3702, Ordinance No. 3778, and
Ordinance No. 3790, being commonly known as Zoning Ordinance of
the City of South Bend, Indiana, be supplemented so as to clas
the above described real estate as a C Commercial district.
