AN ORDINANCE AMENDING ORDINANCE
NO. 3702 COM1x1ONLY KNOWN AS "THE
ZONING ORDINANCE OF THE CITY OF
SOUTH BEND, INDIANA.°
BE IT ORDAINED by the Common Council of the Civil City of South Bend, Indiana:
SECTION I. That Ordinance No. 3702 commonly known as "The Zoning Ordinance
of South Bend, Indiana" be amended by the addition of the following subsection
to Section 18 -d (Jurisdiction):
(9) For the purpose of creating an effective buffer between residential and
commercial or industrial uses, the Board of Zoning Appeals may permit parking
lots in any residential district where the area is adjacent to any commercial
or industrial district.. or is separated therefrom by a street or alley not
over 30 feet in width. Such parking lot shall be subject to any and all con-
ditions that the Board may impose for the protection of residential property.
SECTION ii. This Ordinance shall be in full force and effect from and after
its enactments approval by the Mayor$ and legal publication.

Your City Planning Commission has been unable to date to comply
with Common Council resolution requesting the Planning Commissior.
to make the necessary study and submit the recommendations rela-
tive to the adoption of legislation for off-street parking re-
quirements. The Commission and the Commission staff are and have
been working towards this recommendation and will report it out
at the earliest possible date.
In the meantime, Ordinance 3702, the Zoning Ordinance of South
Bend, does not give the Board of Appeals explicit or implicit au-
thority to grant off-street parking lots as a transitional use
between residential and commercial or industrial use in an area
zoned residentially. Parking lots developed under certain res-
trictions and conditions imposed by the Board of Appeals offer a
very good transitional use beta -Teen the different areas.
The proposed Ordinance presented herewith will give the Board of
Appeals the necessary authority to grant such uses. The Ordinance
was legally advertised under date of September 28, 1954 and a pub-
lic hearing was held by your Planning Commission under date of
October271, 1954. The Ordinance is favorably recommended.
