Qj L 6 ?, AN ORDINANCE AMENDING CHAPTER 29 OF GENERAL ORDINANCE NO. 3709 KNOWN AS THE 1949 MUNICIPAL CODE OF THE CITY OF SOUTH BEND2 INDIANA BY ADDING THERETO SECTION 38A ENTITLED "YIELDING RIGHT OF WAY." BE IT ORDAINED by the Common Council of the Civil City of South Bend, Indiana: ECTION I: That Chapter 29 of General Ordinance No. 3709 known as The 1949 Municipal Code of the City of South Bend, Indiana be, and the same is, hereby amended by the addition of the following paragraph: 38A. YIELDING RIGHT OF WAY. When "Yield Right of Way" signs are erected by authority of the Board of Public Works and Safety upon streets and highways in the City of South Bend, Indiana the driver of a vehicle approaching a "YIELD RIGHT OF WAY" sign shall slow to a reasonable speed for existing conditions of traffic and visibility, yield- ing the right of way to all traffic on the intersecting street which is so close as to constitute an immediate hazard. Proceeding past such sign with resultant collision or other interference with traffic on the intersecting street shall be deemed prima facie in violation of this regulation. A motorist proceeding against the "YIELD RIGHT OF WAY" sign, therefore must keep his vehicle under control to the extent that he is prepared to yield or give way to the driver or drivers approaching either from the right or left on the intersecting street, and must be prepared to come to a stop if necessary in order to yield this right of way.
