AN ORDINANCE AMENDING SECTION 7 OF
CHAPTER 4 OF GENERAL ORDINANCE No.
3709 KNOWN AS THE 1949 MUNICIPAL
CODE OF THE CITY OF SOUTH BEND,
INDIANA.
BE IT ORDAINED by the Common Council of the Civil City of South Bend, Indiana:
SECTION I: That Section 7 of Chapter 4 of General Ordinance No. 3709
known as The 1949 Municipal Code of The City of South Bend, Indiana be, and
the same is hereby amended to read as follows:
No person owning or having charge, care,
custody or control of any dog shall cause,
permit or allow the same to be or to run
at large upon any street, alley or other
public place or upon any,private property
or premises other than those of the person
owning or having charge, care, custody or
control of such dog within the limits of
The City of South Bend unless such dog
be restrained by a substantial chain or
leash and is in the charge and control of
a competent person.

SECTION II: That this Ordinance shall be in full force and effect from
and after its adoption by the Common Council and its approval by the Mayor,,
and legal publication.

REPORT OF COMMITTEE ON DOG ORDINANCE
The Committee met Thursday, April 9th, 1953, and present were
Councilmen Korpal, Muszynski and Hahn, representing Councilman
Erler, and Mrs* Martha Flanagan of The South Bend Humane Society.
After lengthy discussion the Committee would like for the Council
to postpone the third reading of the ordinance for thirty daysq
so that a new model ordinance could be drawn up for complete
control of dogs and Mr. Andrews from the National Humane Society
would be present to make suggestions.

To The Honorable Members of South Bend City Council:
I would like for the city council to consider at April 73 meeting the pro-
blem of removing the location of The South Bend Humane Society from 1135
Beyer Avenue to a location outside city limits. We people living (I live at
17141 Belmont) on Belmont and Longfellow Avenue are sure the keeping of so
many, ma I think at least 40 at times, dogs constitutes a public nuisance.
Tgey start barking at around 5:00 o'clock in the morning. Householders
have protested to Humane Society. I wrote Mrs. Flannegan this week asking
them to get the problem solved.
It becomes, so far as we are concerned a matter of human welfare over dogs
or dogs over humans. I like dogs but in their place. We do not like to be
awakened and disturbed by them constantly.
My second problem concerns packs of dogs roaming about Perley School, as
many as 10 in•a pack. Several children have had minor bites by dogs.
Sooner or later unless the situation is corrected some one of our 1450 students
will be hurt seriously.
We have announced repeatedly for children to keep their dogs home. We called
the city dog pound on numerous occasions. This morning Rey call to dog pound
at 8:15 got assurance they would be out. They never showed up. I am recommend-
ing that an ordinance with teeth in it be passed to solve this very unsatis-
factory condition.

.Answering your request for information
concerning the dog ordinance, we are submitting
the following information.
During the month of January we answered
192 dog complaints and we destroyed 100 dogs. In
February we answered 198 complaints and destroyed
106 dogs. The first 15 days of March we answered
112 complaints and destroyed 58 dogs.
In addition we picked up and hauled to
the disposal unit, 791 dogs and 93 cats in the
first 15 days of parch 1953.
