AN ORDINANCE AUTHORIZING THE SALE OF A DWELLING'HOUSE'
LOCATED ON THE FOLLOWING DESCRIBED REAL ESTATE: A
LOT OR PARCEL OF LAND THIRTY -THREE (33) FEET IN WIDTH,
NORTH AND SOUTH, TAKEN OFF OF AND FROM THE ENTIRE
WIDTH OF THE SOUTH ENDS OF LOTS NUMBERED 17, 18, 19
AND 20 AS SHOWN ON THE RECORDED PLAT OF THOMAS E. A.
BYERLEY'S ADDITION TO THE TOWN OF MYLER, NOW A PART
OF THE CITY OF O TH BEND, AND COMMONLY DESCRIBED AS
THE CORNER OFI9SAWrAVENUE AND KEMBLE STREET IN
THE CITY OF SOUTH BEND, INDIANA, OWNED BY THE MUNICIPAL
CITY OF SOUTH BEND
WHEREAS, the City of South Bend is the owner of a dwelling house

located on the following described real estate: A Lot or parcel of land Thirty-

Three (33) feet in width, North and South, taken off of and from the entire
width of the South ends of Lots Numbered 17, 18, 19 and 20 as shown on the
recorded Plat of Thomas E. A. Byerley's Addition to the Town of Myler, now

a part of the City of South Bend and commonly known as the corner of N*e:&�
Avenue and Kemble Street in the City of South Bend, Indiana, by virtue of a
warranty deed dated the first day of May, 1957, and
WHEREAS, the above described dwelling house is conducive to no
public use by the Municipal City of South Bend, and it is for the best interests
of the Municipal City of South Bend that said dwelling house be sold.
NOW, THEREFORE, BE IT ORDAINED by the Common Council of
the City of South Bend, Indiana:
SECTION I. That the Judge of the Circuit Court of St. Joseph County, Indiana,
has already been requested to appoint three disinterested freeholders of the
City of South Bend, Indiana, to appraise the value of the dwelling house located
at the corner of Avenue and Kemble Street, South Bend, Indiana, and
more specifically described as follows:
A Lot or parcel of land Thirty -three (33) feet in width,
North and South, taken off of and from the entire width of
the South ends of Lots Numbered 17, 18, 19 and 20 as
shown on the recorded Plat of Thomas E. A. Byerley's
Addition to the Town of Myler, now a part of the City
of South Bend,
which real estate is owned by the Municipal City of South Bend together with
the dwelling house located thereon.
SECTION II. That the City of South Bend sell, assign, transfer, convey and
set over by proper instrument in writing the dwelling house hereinabove
described for not less than the full appraised value thereof as reported by
the appraisers appointed by the Judge of the Circuit Court of St. Joseph. County,
Indiana; and the Mayor is hereby ordered, directed and authorized to deliver to
such purchaser or purchasers thereof upon payment of a sum over and above
the appraised value thereof a bill of sale, and this shall be sufficient notice

and authority to him in said premises.
SECTION III. That further as a condition of said sale it shall be the responsi-
bility of the purchaser to remove the dwelling house from the premises at the
purchaser's own expense within one week after date of sale.
SECTION IV. That this ordinance shall be in full force and effect from and
after its passage by the Common Council and its approval by the Mayor.
