Ordinance No. 3702, as amended, which ordinance is commonly known as the Zoning Ordinance of the City of South Bend, Indiana, be and the same hereby is amended in order that the zoning classification of the following described real estate in the City of South Bend, St. Joseph County, State of Indiana: Commencing at the intersection of the north line of Ruskin Street and the east line of Esther Street, thence East along the north line of Ruskin Street 166 feet; thence North 166 feet; thence West 166 feet to the east line of Esther Street; thence South along the east line of Esther Street 166 feet to the place of beginning. be and the same hereby is changed from a "B" Residence Use District and an "A" Height and Area District to a "D" Light Industrial Use District and an "E" Height and Area District. Section 2. HUFF DIRECTOR OF PLANNING Honorable Common Council City of South Bend South Bend, Indiana Gentlemen: 5 April 1957 The attached petition of Associates Investment Company to rezone land at the intersection of Esther and Ruskin Streets from "B" Residential use District and "A" Hetght and Area District to "D" Light Industrial Use District and "E" Height and Area District being: Lots I, 2,.and 3 in John Adams First Addition located at the northeast corner of Ruskin and Esther Streets, AND Also a tract of land south of Ruskin Street, to -wit: Commencing on the south line of Ruskin Street at a point. 136 feet East of the east line of Esther Street, thence South 297 feet; thence East 332.45 feet; thence North 297 feet to the south line of Ruskin Street; thence west 333.46 feet, more or less, along the south line of Ruskin Street to the place of beginning. This petition was legally advertised under date of 25 March 1957 and given public hearing under date of 4 April 1957. The following action was taken: After due consideration the Commission found that the general area south of Ruskin Street is residential as to use and zoning, that the subject area is adequate in size, shape and area for residential development; that light industrial use of subject area would be an unwarranted and unjustifiable intrusion into a residential area; that no general neighborhood need was shown for increased industrial land -2- and that in fact, ample industrial land suitable for the purpose proposed in Associates Investment Company petition existed in the light industrially zoned tract north of Ruskin Street. The Commission further found that aforesaid Lots I, 2, and 3 of John Adams First Addition are in a block which is pre- dominately zoned for light industrial purposes and that the best use of said land would be light industrial. It was therefore moved by Mr. Van DeVeire, seconded by Mr. Muszynski that the Planning Commission recommend Lots I, 2, and 3 of John Adams First Addition favorably to the Common Council and further that petition area south of Ruskin Street be unfavorably recommended.
