O R D I N A N C E NO.
AN ORDINANCE AMENDING ORDINANCE NO. 3 / o d
COMMONLY KNOWN AS THE ZONING ORDINANCE OF
THE CITY OF SOUTH BEND INDIANA.
BE IT ORDAINED by the COMMON COUNCIL of the City of
South Bend, Indiana:
SECTION 1
That the property situate in the City of South Bend,
Indiana, and described as follows, to -wit:
Lot Numbered Sixteen (16), Oak Park First
Addition to the City of South Bend, common-
ly referred to as lotj East Dubail Avenue,
in the City of South Bend, St. Joseph
County, Indiana,
be rezoned to "B" Residential Use District and "B" Height and
Area District.
SECTION 2
This Ordinance shall be in full force and effect from
and after its enactment, approved by the Mayor, and legal publication.

Park First Addition to the City of
South Bend, commonly known as 1017
East Dubail Street, South Bend, Ind.
Dear Mr. Korpal:
This is a follow -up of our letter, dated May 9, 1958, pertain-
ing to the Buy and Sell Agreement with Jess F. Riggs and Deloros
Riggs for the purchase of Lot 16, Oak Park First Addition to the
City of South Bend. This property is commonly described as 1017
East Dubail Street, South Bend, Indiana.
You will recall that at the Council meeting of May 12, 1958, that
the Council read the Ordinance for the first and second time, and
set it for public hearing on final passage on May 26, 1958.
Please be advised that Mr. and Mrs. Riggs have conveyed the prop-
erty to our client, Richard J. Birmingham and Jeanne M. Birming-
ham, husband and wife, on May 15, 1958 and the Warranty Deed has
been recorded in Deed Record Book 578, page 182, of the records
of the St. Joseph County Recorder's office. Doctor and Mrs. Bir-
mingham are now the owners of said real estate. We, therefore,
would appreciate your continuing on the hearing on zoning matter,
and to zone the real estate "B" Residential Use as recommended
by the South Bend Planning Commission.

The attached petition of Jess Riggs, 1623 Miami Street, to zone
the lot at 1017 East Dubail Avenue from "A" Residential Use District
to "B" Residential Use District and "B" Height and Area District
was legally advertised on 214 March 1958 and given public hearing
under date of 3 April 1958. The following action was taken:
After due consideration the Commission found that the
granting of the petition would constitute an adequate
buffer. It was therefore duly moved, seconded and
unanimously carried that the petition be recommended
favorably.
