An Ordinance Providing for the Annexation of Certain Territory
to the City of South Bend, Indiana
Be it Ordained by the Common Council of the City of South Bend, Indiana:
Section 1. That the following described territory in St. Joseph County,
State of Indiana, be and the same is hereby annexed to and shall constitute hereafter
a part of the City of South Bend, Indiana.
A tract of land located in the Southeast Quarter of Section
Nineteen (19), Township Thirty -seven (37) North, Range Three (3)
East, and the Northeast Quarter of Section Thirty (30) Township
Thirty -seven (37) North, Range Three (3) East, which is also known
as part of Lot Three (3) as shown on the Plat of Division in the
Partition in the St. Joseph Circuit Court at the October term 1878
in which Sarah Denslow was plaintiff and Robert G. Denslow and
others were defendants, a transcript of which partition is recorded
in Deed Record Volume 60, page 338 of the records of St. Joseph
County, Indiana, and which is more particularly described as follows:
Beginning at a point that is Nine Hundred Thirty -eight and Sixty-
five Hundredths (938.65) feet West of the Southeast corner of said
Section Nineteen and on the South line of Section Nineteen (19); said
line is also the South line of said Lot Three (3); thence north
parallel to the East line of said Section Nineteen (19) for a distance
of Two Hundred Ninety -one and Six Tenths (291.6) feet to the North
line of said Lot Three (3); thence West parallel to the South line of
Section Nineteen (19) for a distance of One Thousand One Hundred
Twenty -five and Sixty -seven Hundredths (11125.67) feet to a point on the
North line of said Lot Three (3), said point is also the Northeast
corner of Lot MS^ in the recorded plat of Broadmoor Fourth Section in
the City of South Bend, Indiana; thence South along the East line of
Lot "S'" in the recorded Plat of Broadmoor Fourth Section for a
distance of Two Hundred Ninety -one and Six Tenths (291.6) feet to the
South line of said Section Nineteen (19), said line is also the North
line of Section Thirty (30); thence continuing South along the East
line of Lot �"S" in the recorded plat of Broadmoor Fourth Section for
a distance of Four Hundred Seventy -seven and Ninety -seven Hundredths
(477.97) feet to a point on the South line of said Lot Three (3);
thence East along the South line of Lot Three (3) for a distance of
Seven Hundred Forty -five and Eighty -four Hundredths (745.84) feet to
the Southeast corner of said Lot Three, said corner is on the West
line of the recorded Plat of Meadow View First Addition in St. Joseph
County, Indiana; thence North along the East line of said Lot Three
(3) also knoin as the West line of the recorded Plat of Meadow View
First Addition for a distance of Four Hundred Seventy -seven and Ninety-
seven Hundredths (477.97) feet to the North line of Section Thirty (30)
which is also the South line of Section Nineteen (19) and said line
is also the South line of Lot Three (3); thence East along the South
line of Section Nineteen (19) for a distance of Three Hundred Eighty
and Six Tenths (380.6) feet to the point of beginning.

PETITION FOR ANNEXATION
To the Honorable Common Council of the
City of South Bend, Indiana:
Gentlemen:
South Bend, Indiana
February 1, 1957
Marshall Heights Realty Company respectfully represents and alleges:
1. Petitioner is the owner in fee simple of a tract of land in the
North East Quarter Q) of Section No. 30 and an adjoining tract of land on the
South One -Half (2) of Section No. 19, both tracts being in Township No. 37 North,
Range No. 3 East, St. Joseph County, Indiana, which tracts are more particularly
described as follows:
A parcel of land in the South one -half (2) of Section
No. 19, Township No. 37 North, Range No. Three (3) East,
bounded by a line running as follows, viz: Commencing at a
point on the South line of said Section No. 19, a distance of
938.65 feet West of the Southeast corner of said Section;
running thence North a distance of 291.6 feet; thence West
1119.6 feet; thence South 291.6 feet to the South line of said
Section; thence East on said South line a distance of 1119.6
feet to the place of beginning.
A part of Lot Numbered Three (3) in the Northeast Quarter
of Section Numbered Thirty (30), Township Numbered 37 North,
Range Numbered Three (3) East, as shown on the Plat of Division
in the Partition in the St. Joseph Circuit Court at the October
Term 1878 in which Sarah Denslow was plaintiff and Robert G.
Denslow and others were defendants, a transcript of which partition
is recorded in Deed Record Volume 60, page 338, of the records of
St. Joseph County, Indiana, which part is bounded by a line running
as follows, viz: Beginning at a point 1315 feet West of the North-
east corner of said Section Numbered Thirty (30), Township Numbered
37 North, Range Numbered Three (3) East; thence continuing West 744
feet; thence South 477 feet; thence East 744 feet; thence North 477
feet to the place of beginning.
2. Petitioner has prepared and now awaits preliminary approval of a plat
of the above described real estate as a residential area.
3. Petitioner desires that said territory, being contiguous to the present
southeastern city limits of the City of South Bend, be annexed to and constitute
thereafter a part of the City of South Bend, Indiana, and submit herewith a proposed
form of ordinance for the accomplishment of that purpose.
MEREFORE, petitioner respectfully prays and requests:

1. That this Common Council refer this petition to the City Plan Commission

or its consideration.
2. That upon favorable recommendation by the City Plan Commission, that
this Common Council adopt such proposed form of ordinance for the annexation of said
described territory to the City of South Bend, Indiana.

Common Council.
