SECTION 1. Be it ordained by the Common Council of the City of South Bend, Indiana, that Ordinance No. 3702 of the City of South Bend as amended, be and the same is hereby amended so that the following described real estate Located in the City of South Bend, to -wit: A lot or parcel of land in the City of South Bend, St. Joseph County, Indiana, in the East Half (1 /2) of the Southeast Quarter (1 /4) of Sec- tion Eight (8) in Township Thirty -seven (37) North, Range Three (3) East, described as follows, to -wit: Beginning at the intersection of the West line of Logan Street with the South line of Jefferson Boule- vard, thence running West one hundred thirty -four (134) feet, thence South one hundred fifty (150) feet, thence East one hundred thirtyr three and sixty -eight hundredths (133. 68) feet, thence North one hun- dred fifty (150) feet to the place of beginning, to be known as Lots Numbered One (1), Two (2) and Three (3) in a Proposed Addition of Logan I eights, be zoned in Zone C of the Use District and in Zone D of the Height and Area Dis- trict and said described real estate shall hereafter be governed by all the rules and regulations of said Zoning Ordinance and the amendments thereto governing said re -zoned classification. SECTION 2. Kelsey to zone from "A" Residential to "C" Commercial and "D" Height and Area District lots 15 2, and 3 of Logan Heights Proposed Addition; was legally advertised under date of 28 January 1,057 and given public hearing under date of 8 February 1957• The following action was taken: The Commission found that the other three corners of the intersection of Jefferson and Logan Streets are being used commercially and are so zoned. Subject property is entirely unsuitable for residential use. It was therefore, moved, seconded and unanimously carried that the petition be recommended favorably to the Common Council. KELSEY ) FOR RE- ZONING ) PETITION TO CHANGE ZONING OF LOTS NUMBERED ONE (1), TWO (2) AND THREE (3), LOGAN HEIGHTS PROPOSED ADDITION TO THE CITY OF SOUTH BEND, ST. JOSEPH COUNTY, INDIANA. Comes now Nellie E. Kelsey, the owner of the following described real estate, located in the City of South Bend, St. Josdph County, Indiana, to -wit: Lots Numbered One (1), Two (2) and Three (3), Logan Heights Proposed Addition to the City of South Bend, described as beginning at the intersection of the West line of Logan Street at the South line of Jefferson Boulevard thence West one hundred thirty -four (134) feet; thence South one Hundred fifty (150) feet; thence East one hundred thirty -three and sixty -eight hundredths (133. 68) feet; thence North one hun- dred fifty (160) feet to the place of beginning. Your petitioner respectfully petitions the City Plan Commission of the City of South Bend and the City Council of said City to recommend and re -zone said described real estate from A- Residential and A- Height and Area to C -Com- mercial and D- Height and Area. Your petitioner respectfully shows that said real estate is located on the Southwesterly corner of the intersection of said Jefferson and Logan Streets in said City of South Bend and that the lands on the Easterly side of Logan Street are in the City of Mishawaka, Indiana. The three other corners of said inter- section are zoned commercial and are improved with commercial buildings which have been so used for a number of years last past. That the real estate sought to be re -zoned is unimproved and has been tied up in a Barrett Law foreclosure for some years. That the character of the community has considerably changed since it was originally zoned. Your petitioner further shows that the whole block on the Northerly side of Jefferson Boulevard has been zoned Commercial for sometime and that the lands to the East of said intersection are Commercial on both sides of the street for several blocks. Your petitioner shows that the Lands petitioned to be re -zoned are at this time wholly unsuited for residential use on account of the Commercial character of all of the surrounding real estate. That the lands in question are not ohly undesirable for residential purposes but they are of small value as such and are greatly depreciated in value by reason of said continued A- Residential zoning. WHEREFORE, your petitioner respectfully petitions the City Council and the City Plan Commission to recommend and re -zone said real estate as prayed for in this petition and as indicated in the proposed ordinance accompanying the same.
