WHEREAS, the two parcels of real estate hereinafter described are presently zoned as "C" Commercial Use District and "E" Height and Area District, and "B" Resident- ial Use District and "B" Height and Area District respectively; and WHEREAS, the City Plan Commission has recommended that the zoning thereof be changed as hereinafter provided. NOW, THEREFORE, BE IT ORDAINED by the Common Council of the City of South Bend, Indiana, that Ordinance No. 3702, which Ordinance is commonly known as the Zoning Ordinance of the City of South Bend, be amended as follows: Section 1 The following described real estate situated in the City of South Bend be and the same is hereby rezoned as "B" Use District and "B" Height and Area District: Beginning at a point that is One Hundred Seventy -Five (175) feet North of the Northeast corner of the intersection of Huron Street and Lombardy Drive; thence East Two Hundred Fifty (250) feet; thence South Forty -Five and Six - Tenths (45.6) feet; thence West Two Hundred Fifty (250) feet to the East line of Lombardy Drive; thence North Forty-Five and Six- Tenths (45.6) feet to the place of beginning. and The following described real estate situated in the City of South Bend be and the same is hereby rezoned as "C" Use District and "E" Height and Area District: Beginning at a point on the North line of Huron Street that is Fourteen (1 4) feet West of the East line of the West One- Half (z) of the Southwest One- Quarter (4) of Section Nine (9), Township Thirty-Seven (37) North, Range TW& (3) East; thence North One Hundred Seventy -Five (175) feet; thence West Four Hundred Thirty -Five (435) feet; thence North Fifty Eight and Four- Tenths (58.4) feet; thence East Four Hundred Thirty -Five (435) feet; thence South Fifty -Eight and Four- Tenths (58.4) feet to the place of beginning. Petitioner is the owner in fee simple of an undivided parcel of real estate in the City of South Bend, Indiana, bounded on the North by Western Avenue, on the West by Lombardy Drive, on the South by Huron Street and on the East by a Fourteen (14) foot alley that is just west of Gladstone Street. 2. Said parcel of real estate, the North part of which is sometimes known as Part l of Section 8 of Belleville Unit B. and the South part of which is sometimes known as Part 2 of Section 7 of Belleville Unit B, is presently divided by an irregular line into '"C" Commercial in the north part thereof and "B" Residential in the south part thereof. 3. To make both parts more useable to petitioner and to the general public, petitioner desires to straighten the line so separating the different classes of zoning. 4. To accomplish this purpose petitioner requests that the zoning of two small tracts within said parcel of real estate be changed as follows: (1) Tract A. Beginning at a point that is One Hundred Seventy -Five (175) feet North of the Northeast corner of the intersection of Huron Street and Lombardy Drive; thence Past Two Hundred Fifty (250) feet; thence South Forty -Five and Six Tenths (45.6) feet; thence West Two Hun- dred Fifty (250) feet to the East line of Lombardy Drive; thence North Forty -Five and Six - Tenths (45.6) feet to the place of beginning. The zoning of this tract should be changed from *C" Commercial and "E" Height and Area to "B° Residential and "B" Height and Area. (2) Tract B. Beginning at a point on the North line of Huron Street that is Fourteen (14) feet West of the Fast line of the West Line -Half (�) of the Southwest One - Quarter (4) of Section Nine (9), Township Thirty -Seven (37) North, Range Three (A) East; thence North One Hundred Seventy -Five (175) Peet; thence West Four Hundred Thirty - Five (435) feet; thence North Fifty Eight and Four- Tenths (58.4) feet; thence East Four Hundred Thirty -Five (435) feet; thence South Fifty-Eight and Four - Tenths (58.4) feet to the place of beginning. ,The' zoning of this tract should be changed from "B" Residential and "B" Height and Area to "C" Commercial and "E" Height and Area. 5.. When the above changes have been made the zoning for one Hundred Seventy - Five (175) feet North and South all along the North side of Huron Street from Lombardy Drive to the aforementioned Fourteen (14) foot alley will be "B" Residential. The dividing line between such Residentially zoning land and the Commercially zoned land to the North will then be a straight line. b. Petitioner submits herewith a drawing showing exactly the changes desired together with a proposed form of ordinance for the accomplishment of that purpose. WHEEREFOREj, petitioner respectfully praysand requests 1. That this Common Council refer this petition to the City Plan Commission for its consideration. 2. That upon favorable recommendation by th-- City Plan Commission, that this Common Council adopt such proposed form of ordinance for the rezoning of said described territory in the City of South Bend, Indiana. This Petition seeks to change the following described land from TIC" Commercial to IIBII Height and Area District: Beginning 175 feet from the intersection of Huron and Lombardy Drive and being 45 feet North therefrom on Lombardy and 250 feet in depth; And in addition to change from "BIT Residential to TIC" Commercial and "Ell Height and Area District, the following land: Beginning 175 feet North of Huron Street and the North -South alley immediately West of Gladstone Street, thence 58-4 feet North, thence 435 feet West, thence 58.4 feet South, thence 435 feet East.
