HomeMy WebLinkAboutZoning - 35 Acres on East JeffersonORDINANCE No. 4080 Passed by the Common Council of the City of South Bend, March 12 1936 Presented by me to the Mayor of the City of South Bend, Indiana March 13 19356— Clerk of Common Council Approved and signed by me March 14 19836 Clerk 7 Indiana: Section 1 ORDINANCE NO, r ©b AN ORDINANCE AMENDING ORDINANI COMMONLY KNOWN AS THE ZONING OF THE CITY OF SOUTH BEND, Be it ordained by the Common Council of the City of South Bend, Ordinance No. 3702, being a zoning ordinance of the City of South Bend, Indiana, be and the same hereby is amended so that the zon- ing classification of the following real estate in the City of South Bend, In- diana, to -wit: A part of the West One -half (112) of the Northeast Quarter (1/4) of Section Eight (8), Township Thirty -seven (37) North, Range Three (3) East, now within and a part of the City of South Bend, described as follows: Beginning at the center of said Section Eight (8), Township Thirty -seven (37) North, Range Three (3) East; thence North along the North and South center line of said Section Eight (8) a distance of One Thousand One Hundred Forty - one and twenty -five hundredths (1, 141. 25) feet; thence East One Thousand Three Hundred Thirty -five (1, 335) feet, more or less, to the East line of the West One -half (1/2) of the Northeast Quarter (1/4) of said Section Eight (8), thence South One Thousand One Hundred Forty -one and twenty -five hundredths (1, 141.25) feet to the East and West center line of said Section Eight (8), thence West One Thousand Three Hundred Thirty -six and eight - tenths (1, 336.8) feet to the place of beginning, containing Thirty -five (35) acres, more or less. be rezoned from "A" Residence District and "A" Height and Area District to "C -2" Planned Shopping Center District. Light to zone 35 acres on East Jefferson Boulevard to "C-2t' Shopping Center District, as returned to the Planning Commission by the Common Council on February 14, 1956, was considered by your Planning Commission on March 1, 1956, on which date the Commission in executive session, having reconsidered the petition, took the following action: RESOLVED, that the findings adopted by the Commission on January 19, 1956, and the favorable recom- mendation of the Commission to the Common Council be reaffirmed; that the action of the Council rejecting said petition be disapproved; and that a report of this action be filed with the Common Council. Discussion was then had upon the pending action against the Commissioner brought by Louis E. Mundell wherein it is claimed that on January 19, 1956, the Commission found that the area involved in the Light petition does not meet the requirements of the zoning ordinance. It was the consensus that the findings of the Commission show that said area does meet the requirements of the Zoning Ordinance, but to remove ax>,p doubt concerning the findings of the Commission it was on motion duly made, seconded, and unanimously carried: RESOLVED, that it was the finding of the Commission on J.anuary. 19, 1956, 'and : that it is hoW the 'finding of the Commission that the area involved in the Light petition has an acceptable relationship to Honorable Common Council to improved major adequate capacity generated by the RIH:aed -2- March 7, 1956 thoroughfares which possess an to carry the additional traffic commercial district.
