ORDINANCE NO. 4223
Be it ordained by the Common Council of the City of South
Bend, Indiana:
Section 1.
That the property situate in the City of South Bend, Indiana,
and described as follows, to -wit:
Lots Sixty -nine (69), Seventy (70), Seventy -one A VIA),
Seventy -two A (72A), One Hundred five (10510 One_Hundred
six (106), One.Hundred seven (107), and One Hundred eight
(108) as_shown on Meyers and Funkfs Third Plat of Chippewa
Heights Addition to the City of South Bend. All in Sec-
tion Twenty -five (25), Township Thirty -seven (37) North,
Range. Two (2) East, in St.Joseph.County, Indiana; and
being more commonly described as a parcel of land of an
area approximately two hundred (200) feet x three hundred
twenty -eight (328) feet between_trtichigan and Main Strebts,
and immediately north of Albert Street In the south edge
of the city limits of the „City of South Bend,
be zoned to "C” Commercial Use District and "A" Height and Area District.
Section 2
This Ordinance shall be in full force and effect from and after

Gentlemen:
April II, 1958
The attached petition of Blenke Brothers Realty Company, Inc. to
zone the recently annexed land, to wit: Lots 69, 70, 71A, 72A,
and 105 -108, inclusive, of Chippewa Heights 3rd Addition, being
the land west of Highway 31, north of Albert Street, east of Niain
Street and south of the previous City Limits to "C" Commercial
Use District and "A" Height and Area District was legally adver-
tised on 21�March 1958 and given public hearing under date of 3
April 1958. The following action was taken:
After due consideration the Commission found that the
west side of h1 chigan Street, being in the County, was
zoned and fully used commercially; that subject proper-
ty was adjacent thereto and could not, therefore, be
described as spot zoning; that it would be, therefore,
arbitrary and unreasonable to withhold commercial
zoning from subject property; and that substantial justice
would be done by the favorable recommendation of the
petition. It was therefore duly moved, seconded and
unanimously carried that the petition be recommended
favorably to the Common Council.

following described real estate:

1. The real estate herein above described has recently been
annexed to the City of South Bend.
2. Your petitioner submits this proposal and requests that
your Honorable Board amend the Zoning Ordinance to establish this recently
annexed real estate as °C° Commercial Use District and "A° Height and Area
District.
WHEREFORE, your Petitioner respectfully requests Your Honor-
able Common Council to refer this petition to the South Bend City Plan Com-
mission for its consideration, and that upon favorable recommendation by the
City Plan Commission that this Common Council adopt this proposed Ordinance
for zoning the said above described real estate located in the City of South
Bend, Indiana.
