AN ORDIJANCE ALINDING ORDIJANCE NO. 2243 COM1:ONLY 11LJOYfN AS "THE BUILDING CODE OF SOUTH BEND, INDIANA." 3E IT ORDAINLD by the Common Council of the Civil C1.ty of South Bend, Indiana: SECTION 1. That Ordinance .No. 2243 commonly known as "The Building Code of the City of South Bend, Indiana :" be amended so that the same shall hereafter Axe read as follows: SECTION N0, 641 DEFINITION OF A GARAGE: (e) Public and private garages Garages shall be divided into two classes -- Public and Private. Any building housing more than three cars using inflammable liquids in their tanks, or a buildinj in which repairs are made on wheeled vehicles using inflammable liquids in their tanks, shall be designated as a Public Garage. A building or shelter housing not more than three such cars and having not more KR* than one- thousand (1,000) square -feet floor area shall be designated as a Private Garage. When any building exceeds the minimum allowable 1,000 square - foot floor area it shall be classed in the occupancy group other than "Private Garage" that it most nearly resembles. :A CTION NO.657 PRIVATE GARAGES4CONSTRUCTION. Private garages hereafter built, altered, or converted for such purposes within the fireproof limits shall be of fireproof construction; within the fire limits they must be of incombustible construc- tion and have no living quarters above them unless built fireproof as described for public garages. If located in the outer limits, they may be combustible construction except that when any building classified as a private garage is attached to any building of classes 1,2,3, or 4, the separating wall shall be of at least one -hour fire resistive construction; or that when 25 per cent or more of any one wall of a building classified as Private Garage is clo_or that/ three feet (3r) to any building of classes 1,2,3, or 4, except another "Private Garage", Said wall shall be of not less that one -hour fire resistive construction. For the purposes of this Section a "breezeway" connecting the Private Garage to buildings of classes 1,2,3, or 4, shall be considered a class 4 building unless said "breezeway" is at least 75 per cent open on at least two sides. - �, :ten 1 °55 ._.._._� _j EVELYN M.HENNESSY Page -2- CITY CLERK SECTION NO. 658 LIVING QUART'iRS OVER JR C01- TNECTyD WITH 0) 'r'.ER BUILDINGS. Outside the fire limits, if living quarters are provided over, tile garage shall be of fireproof construction up to and including the second floor construction, or -nay be of frame construction if all parts of the structure, including ceilings over the garage, be of at least one -hour fire resistive construction. All doors except those leading to exterior shall be made of incombustible material or covered on the garage side with an approved incombustible material laid on smooth and flat woodwork. Stairways leading to second stories shall be enclosed by partitions of at least one -hour fire resistive construction. Such partitions shall have no openings into garage unless protectedIZX' approved doors as above described. Partitions between garages and ether buildings described in the preceding section shall be un- pierced by any opening unless same be covered by approved protected doors or shutters as above des- cribed. Under no circumstances shall a private garage have any opening directly into a room used for sleeping purposes. SECTION II.
