AN ORDINANCE AUTHORIZING THE TRANSFER AND CONVEY-
ANCE OF VACANT PROPERTY ON NORTHSID.E BOULEVARD
OWNED BY THE CITY OF SOUTH BEND FOR THE USE OF ITS.
PARK DEPARTMENT TO THE BOARD OF TRUSTEES OF
INDIANA UNIVERSITYQ IN ACCORDANCE WITH THE ACTS OF
THE GENERAL ASSEMBLY OF THE STATE OF IND, OF 1951, Chap. 72
BE IT ORDAINED by the Common Council of the Civil City of South Bend,
Indiana:
SECTION I' The vacant property on Northside Boulevard in the City of South
Bend belonging to the City of South Bend for the use of its Park, Department and
more particularly described as follows-
Beginning on the East line of Greenlawn Avenue in the City of South
Bend at a point 1104 feet South and 33 feet East of the North West corner
of the East Half of the North East Fractional Quarter of Section No. 18,
in Township No. 37 North, Range No. 3 East, thence East 226.4 feet to
the South East corner of a tract of land, heretofore conveyed to the Huckins
Tool and Die, Inc; thence North along the East line of said tract, 87. 6
feet to the South West corner of a 5 acre tract of land formerly owned by
Frederick Herman Kops; thence East along the South line of said Kops
land and on said line extending East a distance of 288. 3 feet to the East
line of land formerly owned by the Northern Indiana Transit, Inc; thence
South along said East line 265 feet, more or less, to the Northerly line
of North. Side Boulevard in said City; thence Westerly along the Northerly
line of North Side Boulevard to the East line of Greenlawn Avenue; thence
North along said East line 337.4 feet, more or less, to the place of be-
ginning; excepting therefrom the following:
A parcel of land beginning at a point One Thousand Forty -six and Four
Tenths (1046.4) feet, South Zero- Degrees and: Five Minutes West (S 00
051 W) of a point which is described as being Five Hundred Forty- seven
and Seven Tenths (547. 7) feet East of the intersection of Mishawaka
Avenue and Greenlawn on the center line of said Mishawaka Avenue in the
North East Quarter (NE 1 /4) of Section Eighteen (18); Township Thirty -
seven (37) North, Range Three (3) East, Thence North Eighty -eight De-
grees Fifty -four Minutes (N 880 541) West Fifty (50) feet; Thence South
Zero Degrees Five Minutes (S 00 051) West to a point of intersection with
the North line of North Side Boulevard; Thence North - Easterly along the
North line of North Side Boulevard to a point Two Hundred Forty and
Seventy -four Hundredths (240. 74) feet, South Zero Degrees Five Minutes
(S 00 051) West of point of beginning; Thence North Zero Degrees Five
Minutes East (N 00 051 E) to point of beginning; the same being Fifty
(50) feet off the entire East end of a tract of land owned by the City of
South Bend, Indiana, and designated as Veteran's Memorial Park,
is hereby ordered conveyed to the Board of Trustees of Indiana University by
the Mayor and attested by the City Clerk in accordance with the provisions of
this ordinance.

SECTION II, The Mayor of the City of South Bend is authorized to assign,
transfer, convey and set over by proper legal instrument to the Board of
Trustees of Indiana University the real estate hereinbefore described. Such
conveyance shall be attested by the City Clerk. That there shall be a reser«
vation in said deed that, if the Board of Trustees of Indiana University do
not use said premises for the construction of a building for educational pur-
poses or as facilities attendant to a building for educational purposes within
a period of five (5) years from said conveyance of real estate, the real estate
shall revert to the City of SouthBend for the use of its Park Department.
SECTION III.` This ordinance shall be in full force and effect from and after
its acceptance by the Common Council and approval by the Mayor.
