ADOPTED ON OCTOBER 24, 1923,
BE IT ORDAINED by the Common Council of the City of South Bend, Indiana:
SECTION 1. That Section 6 of Chapter 8 of General Ordinance No. 3709, which
is an ordinance amending Section 1 of Ordinance No. 2464 adopted on April 14,
1925, which is an ordinance amending Section 2 of Ordinance No. 2361 adopted
on October 24, 1923, be and the same is hereby amended to read as follows:
In order to carry out the objects and purposes defined in section 1
of this ordinance, any gifts, donations, bequests, payments on agreements or
contracts for perpetual care, or part of the proceeds of the sale of cemetery
lot or lots within said cemetery, shall be accepted subject to the following con-
ditions, to -wit: All funds given, bequeathed or paid in on contracts or agree"
ments for the purpose of providing perpetual care of cemetery lots, shall be
paid to the City Controller, who shall keep a record thereof and as soon thereafter
as practicable, deposit same with the City Treasurer to the credit of the
Cemetery Trust Fund, It shall be the duty of the City Treasurer to invest the
same in interest bearing bonds of the United States Government or any other
investment which is authorized by statute, and such bonds shall be deposited
with and remain in the custody of such Controller, who shall collect the interest
thereon as the same become due and payable and deposit said interest with the
City Treasurer to the credit of the General Fund, so long as the expense and
maintenance of the City Cemetery is a part of the General Fund budget.
No part of the principal sum of said Cemetery Trust Fund shall
ever be used. Any expense incurred by the Cemetery Trust Fund, such as
bank safety deposit box rent, etc., shall be paid from the Cemetery Appropri-
ation of the General Fund.
If in any special gift or bequest which is to provide perpetual care
for any specific lot or lots in said cemetery, a sum of interest is realized which
is more than would be necessary for that specific lot or lots, any surplus re-
maining shall be used for the care of the cemetery in general.
No gift, donation or bequest shall be accepted for the care of any
specific lot or lots of an amount less than seventy -five (75�) cents per square
foot of land included in such lot or lots.
All contracts or agreements purchased for perpetual care of any
lot or lots shall be made at the rate of seventy-five (75�) cents per square foot
of land in such lot or lots.

PUBLIC HEART and after January 1, 1957.
