AN ORDINANCE ANNEXING TO AND BRINGING WITHIN THE
CITY LIMITS OF SOUTH BEND, INDIANA, CERTAIN LANDS
BE IT ORDAINED BY THE COMMON.COUNCIL OF THE CITY OF SOUTH
BEND, INDIANA:
Section 1:
That the following described property in St. Joseph
County, State of Indiana, is hereby annexed to and brought
within the City of South Bend, Indiana:
Beginning at the intersection of the present City
limits and the north right -of -way line of Lincoln Way
West (U.S. 20) in the Southwest a of Section 33, T.38N.,
R.2E., and continuing westerly along the north right -
of -way line of Lincoln Way West to the east right -of-
way line of Butternut Road; thence north along the east
right -of -way line of Butternut Road to the east -west
center section line of Section 29, T.38N., R.2E.;
thence east along said center section line to the west
boundary of Section 28, T.38N., R.2E.; thence east
along the east -west center section line of Section 28,
T.38N., R.2E., to a point 660 feet, more or less, west
of Maple Road; thence north parallel with Maple Road
to the south right -of -way line of Cleveland Road; thence,
easterly along the south right -of -way line of Cleveland
Road to the intersection of the west section line of
Section 27, T.38N., R.2E.; thence north along said sec-
tion line to the south right -of -way line of the East -
West Indiana Toll Road; thence easterly along the south
right -of -way line of the East -West Indiana Toll Road to
the west right -of -way line of Portage Avenue; thence
southerly along the west right -of -way line of Portage
Avenue to the present City limits; thence generally
west and south along the present City limits to the
point of beginning containing 1,544.acres, more or less.
Section 2•
This Ordinance shall be in full force and effect
from and after its enactment, approval by the Mayor and
legal publication.

The attached proposed ordinance originated by the Common
Council to,annex to the City of.South Bend, Indiana the
property generally described as bounded on the north by
the east -west center section line of Sections 28 and 29
T.38N., R.2E., and the Indiana Toll Road; on the east by
Portage Avenue and the present City Limits; on the south
by the present City Limits and Lincoln Way West and on
the west by Butternut Road containing approximately 1,544
acres was legally advertised on February 20, 1961 and
given two public hearings under the dates of October 27,
1960 and March 2, 1961. In addition to the public hearings
two meetings were held between the Planning Commission's
Committee on Annexation and a committee of residents from
the proposed annexation area. The following action was
taken:
After due consideration the Commission found that
in their opinion:
1. The annexation is in the best interests of
the city and of the territory to be
annexed.
2. The area is urban in character, being an eco-
nomic and social part of the annexing city.
3. The city is financially able to provide muni-
cipal services to the annexed area within
the reasonably near future.
4. The area sought to be annexed is needed for
development of the city in the reasonably
near future.
