MARCH 27. 19 61 Presented by me to the Mayor of the City of South Bend, Approved and signed by r MARCH 28, 61 �9 Clerk of Common Council MARCH 28, 19 61 Clerk IDEAL PRESS ORDINANCE NO. 1-1-,.3 2D -� J AN ORDINANCE AUTHORIZING THE SALE OF A TRACT OF LAND OWNED BY THE MUNICIPAL CITY OF SOUTH BEND, ST, JOSEPH COUMY, INDIANA, DESCRIBED AS FOLLOWS: A strip of land fifty (50) feet wide located in the Northwest one quarter (1/4) of the Northwest one quarter (1/4) of Section One (1), Township thirty seven (37) North, Range Two (2) East, South Bend, Indiana, more particularly described as follows: All right of way adjacent to and East of the Michigan Central Railroad Company's right of way lying south of the south line of Pokagon Street and northerly and westerly of the west line of the right of way of State Road No, thirty-one (31) as acquired by condemnation proceedings by Resolution No. 2481 of the Board of Public Works and Safety of the City of South Bend, Indiana; the above described tract being a part of land which was conveyed to the grantors predecessors in title by Samuel Leeper and wife on July 17, 1902 and recorded in the records of St. Joseph County in Deed Record 122, page 379 WHEREAS, the Municipal City of South Bend is the owner of a certain tract of land located in the City of South Bend, St. Joseph County, Indiana and WHEREAS, the said real estate herein described is conducive to no public use by the Municipal City of South Bend, Indiana, in the best interests of said City should be sold. NOW, THEREFORE, be it ordained by the Common Council of the City of South Bend, Indiana: SECTION I, That the Judge of the St. Joseph County Circuit Court be requested to appoint three disinterested freeholders of the City of South Bend to appraise a tract of land now owned by the Municipal City of South Bend, located in the City of South Bend, St. Joseph County, Indiana, described as follows: A strip of land fifty feet (50) wide located in the Northwest one quarter (1/4) of the Northwest one quarter (1/4) of Section One (1), Township Thirty - seven (37) North, Range Two (2) East, South Bend, Indiana more particularly described as follows: All right of way adjacent to and East of the Michigan Central Railroad Company's right of way lying south of the south line of Pokagon Street and northerly and westerly of the west line of the right of way of State Road No. Thirty-one (3 1) as vffquired by condemnation proceedings by resolution No. 2481 of the Board of Public Works and Safety of the City of South Bend, Indiana; the above described tract being a part of land which was conveyed to the grantors predecessors in title by Samuel Leeper and wife on July 17, 1902 and recorded in the records of St. Joseph County in Deed Record 122, Page 379, SECTION II. That the City of South Bend sell, assign, transfer, convey and set over by proper instrument, in writing, to any pur- chaser thereof the real estate hereinabove described for not less than the full appraised value thereof as reported by the appraisers appointed by the Judge of the Circuit Court of St. Joseph County, Indiana, and the Mayor is hereby ordered, directed and authorized to execute and deliver to such purchaser or purchasers thereof,, upon the payment of not less than the appraised value thereof, a good and sufficient deed, and this shall be sufficient authority to him in said premises. SECTION III.
