Be It Ordained by the Common CounclL,of the City of South Bend,

That the property situate in the City of South Bend, Indiana, and
described as follows, to -wit:
Lots Seventy -three (73), Seventy -four (74), One Hundred
Three (103), and One Hundred Four (104), as shown on the
recorded plat of Myers and Funk's Third P,Iat of Chippewa
Heights Addition to the City of South Bend, Indiana, as
shown In-Plat Book to, page,176 of the records of the St.
Joseph County Recorder's Office; said real estate being
more commonly described as a parcel of :.land of an area
one Hundred (IOO) feet by three hundred twenty -eight (328)
feet. between-Michigan and Main Streets, and immediately
South of Barbee Street (formerly known as Albert Street)
in the South edge of the city ,limits of the City of South
Bend,
be zoned to "C" Commercial Use District and "A" Height and Area District.

This Ordinance shall be in full.[ force and effect from and after its
enactment, approval by the !Mayor, and legal publication.

The attached petition of Northern Indiana Development
Company, Inc., and Lowell E. Buschbaum to zone recently
annexed land being Lots Numbered 73, 74, 103, and 104,
as shown on the recorded Plat of Myers and Funk's Third
Plat of Chippewa Heights Addition to the City of South
Bend, Indiana, said real estate being more commonly
described as a parcel of land 100 feet by 328 feet between
Michigan and Main Streets, and immediately south of
Barbie Street (formerly known as Albert Street) in the
south edge of the City limits of the City of South Bend,
to "C" Commercial Use District and "A" Height and Area
District was legally advertised under date of January 23,
1961 and given public hearing under date of February 2,
1961. The following action was taken:
After due consideration the Commission found that
the desired zoning for the property in question
would be the best possible zoning for said land
area in view of the following reasons:
1. The land area directly north of the property
in question is zoned IICII Commercial Use and
"A" Height and Area District,
2. The property in question lies between two
designated major thoroughfares, providing
adequate traffic circulation.
3. The land area east and south of the property
in question is zoned by the County for com-
mercial purposestand is completely in com-
mercial use.

It was therefore duly moved., seconded, and unani-
mously carried that the petition be recommended.

PETITION TO AMEND ZONING ORDINANCE ON RECENTLY ANNEXED
LAND
TO: THE HONORABLE COMMON COUNCIL
OF THE CITY.OF SOUTH BEND, INDIANA
Gentlemen:
NORTHERN INDIANA DEVELOPMENT CO., INC. and LOWELL E. BUSCHBAUM,
by way of their attorneys, FEENEY & STRATIGOS, petition the Common Council as
follows:
1. That they are the owners of the following described real estate
situate in the City of South Bend, County of St.Joseph, State of Indiana, to —wit:
Lots Seventy —three (73), Seventy —four (74), One Hundred
Three (103), and One Hundred Four (104), as shown on the
recorded Plat of Myers and Funk's Third Plat of Chippewa
Heights Addition to the City of South Bend, Indiana, as
shown in Plat Book 10, page 176 of the records of the St.
Joseph County Recorder's Office; said real estate being
more commonly described as a parcel of land of an area
one hundred (100) feet by three hundred twenty —eight (328)
feet between Michigan and Main Streets, and immediately
South of Barbie Street (formerly known as Albert Street)
in the South edge of the city limits of the City of South
Bend.
2. The real estate hereinabove described has recently been annexed
to the City of South Bend.
3. Your petitioners submit this proposal and request that your Honor-
able Board amend the Zoning Ordinance to establish this recently annexed real estate
as "C" Commercial Use District and "A" Height and Area District.
WHEREFORE, your petitioners respectfully request your Honorable Common
Council to refer this petition to the South Bend City Plan Commission for its con-
sideration, and that upon favorable recommendation by the City Plan Commission that
this Common Council adopt this proposed Ordinance for zoning the above described
real estate located in the City of South Bend, Indiana.
