AN ORDILANCE APPROVING AN OPTION TO RENEW A
LEASE BETWEEN THE MUNICIPAL CITY OF SOUTH
BEND, INDIANA_ , AND PETER F. NEMETH AND
MARGARET K'' NEMETH FOR THE PREMISES COMMONLY
KNOWN AS 114 SOUTH CHAPIN STREET, AS WELL AS
THE USE OF A PORTION OF LAND ADJACENT THERETO
WHEREAS, heretofore on the 31st day of May; 1960; the City of
South Bend; Indiana, by and through its Board of Public Works and Safety
pursuant to a resolution duly adopted, made and entered into the following lease
agreement with Peter F • Nemeth and Margaret K.. Nemeth, and
WHEREAS;` said Board of Public Works and Safety pursuant to
resolution duly adopted exercised option in said agreement and said agreement
is set out as follows, to--wit:

THIS INDENTURE made this day or % /Z , 1960, in the
year of our Lord One Thousand Nine Hundred and Six ",yf between PET'E:R F.
NEMETI4 and MARGARET K. NEMETII _ailed the Lessor and ±.hr
MUNICIPAL CITY OF SOUTH BEND, a mt:n:cipai co,,poration, h?r = inaftcr
called the Lessee.
WITNESSETH:
1, The Lessor herein leases unto the Lessee, subject W and upon the
terms hereinafter stated for the *term of seven (7) rnoriths beginning on the lst day
of June, 1960, and ending on the 31st day of December, 19611, the use an(? enjoy-
ment of all and singular the premises at 114 South Chapin Street, South Bend,
Indiana, as well as the use of a portion of land adjacent thereto, on which the
Lessee shall be permitted to park not more than three (3) vehicles, all in the City
of South Bend, including all appurtenances thereto, at a rental of Two Hundred
seventeen ($217) Dollars per month.
2. The Lessor agrees to provide 'neat 6 r the above demised premises,
as well as water and electricity.
3. The Lessee shall have and the Lessor hereby grants to the Lessee
the option and right to renew this term on the conditions herein contained for an
addition term of one (1) year and from year to year thereafter, on or before the
20th day of Decerrru6r, 1960, and on or before the 20th day of December each year
thereafter.
4. That the Lessee has received the premises in good order and repair
and that said Lessee will keep said p7ernisu6 in good repair, replacing all broken
glass with glass of the same size and quality as that broken, and vAll keep said
premises and appurtenances, including catch basin in a clean and healthy condition,
and upon termination of this lease will yield up said premis es to the Lessor in
good condition and repair, loss by fire and ordinary wear excepted.

5. Lessor further grants to the Lessee the right to make all reason-
able alterations, additions or c:ianges in anal s;.l` p'- en1ises, subject to the
suba')issi.on of plans for said alterations, z? iti.ms, or changes to the Lessor.

7. Lessee will allow the Lessor free access to the premises hereby
leased for the purposes of examining or exhibiting the same or to make any
needful repairs of said premises, which said Lessor may see fit to make.
8. It is hereby mutually agreed that in the event said premises are
damaged or destroyed by fire or other causes so as to render same wholly unfit
for occupancy and use thereof by Lessee, then this lease shall terminate. If,
however, only a portion of said premises are rendered unfit. Lessee may refrain
on the said portion thereof and the rent for the unfit portion shall abate, or the
Lessee may declare this lease terminated.
IN WITNESS WHEREOF, the parties have hereto set their hands and

WHEREAS, said lease agreement contained an option for the renewal
of the said lease under the same terms and conditions for an additional term of
one year as set out thereim, and
WHEREAS, said agreement is now submitted to the Common Council
of the City of South Bend, Indiana for its approval of the exercising of said option
by Ordinance;
NOW, THEREFORE., BE IT ORDAINED by the Common Council
of the City of South Bend,, Indiana:
SECTION 1 That the option to renew said lease for the year 1961
by and between the Municipal City of South Bend., Indiana and Peter Fe� Nemeth

and Margaret K. Nemeth be and the same is hereby in all things ratifiedv con-
firmed and approved.
SECTION 2. This Ordinance shall be in full force and effect from
and after its passage by the Common Council and its approval by the Mayor*
