AN ORDINANCE AMENDING ORDINANCE NO. 3702
COMMONLY KNOWN AS THE ZONING ORDINANCE.
BE IT ORDAINED by the Common Council of the City of South Bend,
Indiana:
Section 1. That Ordinance No. 3702 adopted by the Common Council of the
City of South Bend, Indiana, on the 13th day of June, 1949, and commonly known as
the Zoning Ordinance, be and the same is hereby amended as follows, to -wit:
That the zoning of the following described real estate situate in the City of
South Bend, Indiana, and described as follows, to -wit:
Beginning at a ppint on the North line and nine (9) feet east of the North
West corner of Lot Numbered 14 as shown on the Recorded Plat of Leeper's
2nd Addition to the City of South Bend, which place of beginning is the
West line of North Michigan Street, thence south along the West line of
Michigan Street 298.5 feet to the East line of the old right -of -way of the
Northern Indiana Railway Company, now owned by the Indiana & Michigan
Electric Company; thence Northwesterly along the East line of said right -of-
way to a point due west of the place of beginning; thence east across a
vacated 20 foot alley and along the Northerly line of Lot Numbered 15 as
shown on the Recorded Plat of Samuel Leeper's 2nd Addition to the City of
South Bend, and the North I ine of a portion of Lot Numbered 14 in said
Addition to the place of beginning.
And which said real estate is more commonly known as 1301 North Michigan
Street in South Bend, Indiana.
be changed from Residential A Height and Area District to Residential B Height and
Area District,
Section 2. This Ordinance shall be in full force and effect from and after its
passage and legal publication.

Gentlemen:
November 14, 1960
The attached petition of Henry and Florence Kelly to re-
zone the property most commonly known as 1301 North
Michigan Street from "A" Residential Use District to
"B" Residential Use District was legally advertised
under date of October 24, 1960 and given public hearing
under date of November 3, 1960. The following action
was taken:
After due consideration the Commission found
that due to the isolated character of the land
and the topography feature which does not lend
itself economically to "A" Residential Use
development the petition should be granted.
It was therefore duly moved, seconded, and
unanimously carried that the petition be
recommended favorably to the Common Council.

PETITION TO REZONE LAND.
South Bend, Indiana, August 3, 1960
TO THE PLAN COMMISSION OF THE
CITY OF SOUTH BEND, INDIANA.
WE, the undersigned, being the owners of the following
described real estate situate in South Bend, St. Joseph County,
Indiana:
Beginning at a point on the North line and
nine (9) feet east of the North West corner
of Lot Numbered 14 as shown on the Recorded
Plat of Leeper's 2nd Addition to the City
of South Bend, which place of beginning is

thence south along the West line of

Your petitioners would represent and show to the
Board that they desire to erect and construct a masonry
apartment building on said real estate of either one or
two stories, the exact size and type of construction to be
determined by a competent architect.
Your petitioners would represent and show to the Board
that they have constructed other buildings in the City of
South Bend, such as the South Bend Motel at 3420 South
Michigan Street, South Bend, Indiana; and, the apartment
the corner of McKinley and Rockne, and,
building located at the corner of Lindsey and Allen Streets ,
South Bend, Indiana. Such construction on this peculiarly
shaped triangle piece of ground would beautify the area and
add to the value of the surrounding real estate.
WHEREFORE, your petitioners respectfully petition
the Board to rezone said real estate from Residential A
to Residential B and for all other andproper
relief.
