AN ORDINANCE APPROPRIATING FROM THE GENERAL,FUND
$1,125. 00 TO OFFICE OF CITY CLERK, ACCOUNT NO. C -11,
SALARY OF CITY CLERK, ALL OF THE BUDGET FOR THE
CIVIL CITY OF SOUTH BEND, INDIANA, FOR 1957, AND DE-
CLARING AN EXTRAORDINARY EMERGENCY.
WHEREAS, under Chapter 357 of the Acts of the General Assembly
of Indiana, the following provision was approved on March 15, 1957:
"SECTION 1. On and after the effective date of this act, clerks
of cities of the first class, second and third class and clerk -
treasurers acting as clerks of cities of the fourth and fifth class
shall receive and the common council of the city shall appropriate
in lieu of; +any salary other than additional compensation provided
for additional duties, annual basic salaries respectively as follows:
first class cities, not less than $4, 500. 00 nor more than $6, 000. 00.
In cities of the second class having a population in excess of 50, 000
and located in counties having a population of not more than 250, 000,
not less than $5, 500. 00 nor more than $6, 000. 00. In cities of the
second class having a population of not less than 35, 000 nor more
than 50, 000, not less than $3, 500. 00 nor more than $4, 500. 00.
Provided, however, that the provisions of this act shall not apply
to any city of the second class that is situated in a county having
a population of more than three hundred thousand according to the
last preceding United States Census.
In cities of the third class, not less than $3, 800. 00 nor more than
$4,300.00.
In cities of the fourth class, not less than $3, 500. 00 nor more than
$4,000.00.
In cities of the fifth class having a population of not less than 7, 000
nor more than 10, 000 not less than $2, 500. 00 nor more than
$3, 500. 00. In cities of the fifth class having a population of not
less than 5, 000 nor more than 7, 000, not less than $2, 000. 00 nor
more than $3, 000. 00.
In cities of the fifth class having a population of not less than
3, 000 nor more than 5, OOQ not less than $2, 000. 00 nor more than
$2, 800. 00. In cities of the fifth class having a population of not
less than 1, 500 nor more than 3, 000, not less than $1, 500. 00
nor more than $2, 000. 00. In cities of the fifth class having a
population less than 1, 500, not less than $500. 00 nor more than
$1,000.00.
SECTION 2. Whereas an emergency exists for the immediate
taking effect of this act, the same shall be in full force and
effect on and after April 1, 1957. "
WHEREAS, the City of SaiW:Bend,.i,$ in'$he classification of a
second class city as set out in the statute cited aboLer --
NO4V, THEREFORE, BE IT ORDAIyD by thg;;G,omrdn ;Council of the City
of South Bend, Indiana:
SECTION I. The following sum of money is hereby appropriated from the
General Fund, $1, 125. 00, to Office of City Clerk, Account C -11, Salary
of City Clerk, all of the budget for the Civil City of South Bend, Indiana, for
1957, and declaring an extraordinary emergency.
SECTION II. The above funds are required for the proper operation and
functioning of the aforementioned department under the budget for the year
1957 and an extraordinary emergency is declared to exist concerning said
appropriation.
SECTION III. That the City Clerk be entitled to receive the difference in
salary as set out in the above statute and her present salary retroactive to
the 1st day of April, 1957.
SECTION IV. This Ordinance shall be in full force and effect from and after
its passage by the Common Council, its approval by the Mayor and the ful-
fillment of all statutory requirements relating to extraordinary emergency
appropriations.
