ORDINANCE NO. 4212
AN ORDINANCE AMENDING GENERAL ORDINANCE NO. 3510
OF THE CITY OF SOUTH BEND, SECTIONS 1 AND 2 THEREOF
PROVIDING FOR THE REGULATION OF INTER -CITY TRUCK
TRAFFIC, AS AMENDED.
BE IT ORDAINED by the Common Council of the City of South Bend that:
SECTION I. That Section 1 of General Ordinance No. 3510 providing for the regulation
of inter -city truck traffic be and is hereby amended to include the following addition-
al paragraph:
(d) All tractor trailer trucks travelling from
a point within the city limits to a point within
the city limits.
SECTION II. That Section 2 of General Ordinance No. 3510 providing for the regulation
of inter -city truck traffic be and is hereby amended to include the following addition-
al paragraph:
(d) Intra -city tractor trailer trucks as defined in
Section 1 (d) hereof shall proceed from a point within
the city, which is their starting point to a point
within the city, which is their destination point by
the shortest combination of state and federal highways,
city truck toutes and access routes as shown on
Schedule 1 attached hereto and made a part of this
ordinance, and shall not drive upon any other public
streets of the city of South Bend at any time;
provided, however, that they shall be permitted to
drive upon such other public streets of such city on
the direction of a city or state police officer or to
follow a marked and established city detour or to
obtain necessary emergency mechanical repair.
SECTION III. This Ordinance shall be in full force and effect from and after its
passage by the Common Council, approval by the Mayor of the City of South Bend and
legal publication.

reasons for my decision to veto this legislation. Will you

Attention: Mr. Stanley Korpal, President
Members of the Common Counci I:
The Common Council in its action on Ordinance No. 4212 did act within its
statutory grants in regulating which. kind of vehicles should, or should not be
permitted use of any of our city streets.
Practically, however, it is my considered judgement that we have not sufficiently
covered the problem of channeling an important factor of our economy. Certainly,
the Council in its action, did not intend to constrict industry nor did it in any way
have any so- called "blackmail" motive in its action.
As I negate this legislative action, at the same time I am ordering the City Traffic
Engineer to immediately call a conference of the truck industry and the Council
Transportation Committee. This conference should, without emotion and without
sentiment, but from a logical and practical standpoint, work out an overall
Ordinance, and to submit it forthwith.
Therefore, 1 am returning this Ordinance with my veto attached thereto.
