AN ORDINANCE AUTHORIZING THE INCREASE OF SEWAGE SERVICE
CHARGES TO ALL USERS OF CITY SEWER SERVICE OR CITY WATER
SERVICE, FOR THE PURPOSE OF REPAIR AND /OR REPLACEMENT OF
WATER SERVICE LINES, SHUT OFF BOXESt AND WATER METER MANHOLES.
WHEREAS, many shut -off boxes at the curb on the streets of South
Band are unserviceable or will become unserviceable in the future, and
WHEREAS, a large number of Residentials Commercial and Industrial
service lines in the streets of the City of South Bend are in a state of
disrepair, whichs in turn, is causing leaksq and
WHEREAS, said.leaks have gone unattended in many instances for
long periods of time due to the failure and inability of property owners
to repair and service said leaks2 and
WHEREAS, said leaks have done and will continue to do tremendous
damage to the public improvements in the streets of South Benda and
WHEREAS, said leaks have caused a great loss of waters and
WHEREAS, said water escaping due to service line leaks is carried
into the sewers of the City of South Bend and then to the sewage treatment
plant which, in turns adds an unnecessary load to said sewage treatment plant
causing wear and tear on said plant as well as use of additional man power,
NOW, THEREFORE, BE IT ORDAINED by the Common Council of the City
of South Bend:
SECTION 1. That the sum of eight GOB) cents per month be added to the sewage
service charge of all domestic water or sewer users
SECTION II. That the sum of twenty -five (.25) cents per month be added to the
sewage service charge of all commercial water or sewer users
SECTION Ill. That the sum of fifty (.50) cents per month be added to the sewage
service charge of all industrial water or sewer users
SECTION IV. That all of said sums of money so collected be deposited in a
separate fund of the Sewage Treatment Plant and that said fund be used solely
for the repair and /or replacement of water service linesq shut -off boxes, and
meter manholes
SECTION _ V. For Domestic accounts. This fund shall insure maintenance, repair
and/or replacement of water lines up to the foundation walls of a residential
building. This will include the main service line even though it may have a
lawn sprinkling connection teed int Noweverg any costs of repair to a lawn sprink-
ling system proper will not be'paid for out of this fund.
SECTION V1. For Commercial and Industrial accounts. This fund shall insure
maintenances repair and/or replacement of water service lines extending to the
property lines ONLY.

SECTION V11. The insurance of maintenance2 repair and /or replacement shall not be
in force on any account that is more than two quarters or six months delinquent
on either the sewage treatment bill or the water consumption bill.
SECTION Vill. No claim for the repair of a water line under this Ordinance will
be honored by the City unless a permit has been issued for such work by the Building
Commissioners all in accordance with provisions set forth in the plumbing code
for the City of South Bendy Indiana and until a certificate of final approval
has been issued by the Building Commissioner of the City of South Bend
SECTION IX. This Ordinance shall be in full force and effect from and after its
passage by the Common Councils its approval b the Mayor and the fulfillment f
