N004t, OLCAM AN ORDINANCE CONTROLLING THE OPERATION OF SELF - SERVICE LAUNDRIES WHEREAS, the operation of self- service laundries without attendants increases the danger of fire, and WHEREAS, it is imperative and urgent for the preservation of the health, safety, sanitation, peace and public welfare of the City of South Bend that proper and adequate regulations be adopted to require operators to be present at self- service laundries. f NOW, THEREFORE, BE IT ORDAINED by the Common Council of the City of South Bend, that SECTION I. Definitions: (a) Operators of Self- service Laundries. The term "operators of self- service laundries" as used in this article' shall mean any person who keeps or maintains a commercial establishment open to the general public, which establishment is equipped with washing machines and /or drying machines for the purposes of cleaning, washing and /or drying laundry and other materials, and which washing and drying machines are self- operated by the general public upon payment of a charge to an attendant or to a coin collection mechanism. (b) Self- service Laundries. The term "self- service laundries" as used in this article shall mean only such laundry establishments which provide self- operated washing and /or drying facilities and which are open and available to the general public. The term does not include any establishments wherein the laundry services are performed by employees of the operator of the laundry establishment, nor does this term as used herein include self- service laundry', facilities which are provided for or established in apartment or multiple - rental units, as long as such self- service laundries are not open to the general public and are restricted in their availability to the tenants or inhabitants of such apartment on multiple- rental units. (c) Attendant. The term "attendant" as used in this article shall mean any person of adult age who is either the operator of said self- service laundry or an authorized employee of said operator. SECTION II. Rules and Regulations for Maintenance and Operation. All self - service laundries shall be maintained and operated in com- pliance with all applicable "fire, health and public safety laws of the State of Indiana, and the ordinances of the City of South -Bend, and the operators thereof in addition thereto shall: (a) Maintain an attendant who shall be present on the immediate premises established for the said self- service laundry during all times as the said laundry is open for business. (b) Keep said establishment free from loiterers or any persons having no legitimate or valid purpose for entering or remaining on said premises. (c) Keep said establishment clean and free from any accumulation of combustible materials and to remove from said drying machines and from the vicinity thereof all accumulation of lint and any other combustible materials, said removal of lint'and combustible materials to be performed at least once every eight (8) hours that: said establishment is open for 'business'` (d) Install and keep available fire extinguishers recommended and approved by the South Bend Fire Department in the premises provided for the self- service laundry. a SECTION III. Inspection. It shall be the duty of the fire inspection bureau to inspect each and every self- service laundry at least once every three (3) months for the purpose of determining whether or-,not the owner or operator thereof is observing and abiding by they rules and regulations of this article. SECTION IV. Penalties. Any violation of this article or failure to comply with any provision of this article within thirty days after the effective date hereof, shall be punish- able by a fine not to exceed Three Hundred ($300.00) Dollars, or by imprison' ment not to exceed thirty (30) days, or both, and each day such violation shall continue shall be deemed a separate and distinct offense. SECTION V. This Ordinance shall be in full force and effect from and after its passage by the Common Council, its approval by the Mayor and the fulfill- ment of all statutory requirements relating thereto.
