AN ORDINANCE OF THE COMMON COUNCIL OF THE CITY OF SOUTH BEND,
INDIANA, ANNEXING TO THE CITY OF SOUTH BEND CERTAIN TERRITORY
CONTIGUOUS THEREWITH LOCATED IN GERMAN TOWNSHIP, ST. JOSEPH
COUNTY, INDIANA (STASZEWSKI ANNEXATION) AND
CHANGING ZONING DESIGNATION
The Common Council of the City of South Bend, Indiana has determined that it is in the
best interest of the City of South Bend to annex and bring within the corporate limits of the City
of South Bend certain territory that is contiguous with the City of South Bend.
NOW, THEREFORE, BE IT ORDAINED BY THE COMMON COUNCIL OF THE
CITY OF SOUTH BEND, INDIANA, as follows:
SECTION I. The following described real estate situated in St. Joseph County,
Indiana, having approximately 70% of its aggregate external boundaries contiguous with the
present boundaries of the City of South Bend, Indiana, shall be and hereby is annexed to and
brought within the City of South Bend, Indiana. This property contains approximately 0.5 acres
and its general boundaries are the East side of Olive Road, approximately 1,300 feet north of
Cleveland Road, having a more specific legal description as follows:
A parcel of land being in the Southwest Quarter of Section 19, Township 38 --
North, Range 2 East, German Township, St. Joseph County, Indiana and being
more particularly described as follows:
Commencing at the southwest corner of Section 19, Township 38 North, Range 2
east; thence Northerly 2,855.36 feet to a point, said point being the intersection of
the Westerly line of said section and the centerline of the Indiana East-West Toll
Road; thence Easterly along the centerline of said Toll Road 1,019.36 feet to a
point, said point being the intersection of Olive Road and said Toll Road; thence
Southerly along the centerline of Olive Road 1,416.28 feet; thence Easterly 20
feet to the easterly right-of--way line of Olive Road and place of beginning; thence
Easterly 180 feet to a point; thence Southerly 120 feet to a point; thence Westerly
180 feet to a point; thence Northerly 120 feet to the point and place of beginning.
SECTION II. The above-described real estate is needed and can be used by the City for
its development in the reasonably near future.
SECTION III. The boundaries of the City of South Bend, Indiana, shall be and hereby
are declared to be extended so as to include all of the above-described real estate as a part of the
City of South Bend, Indiana.
SECTION IV. The zoning classification of the annexation area described in Section I
shall be and hereby is designated as `D" Light Industrial; "A" Height and Area, pursuant to the
authority of the South Bend Municipal Code, Chapter 21, Article 7, Section 21-128(a)
SECTION V. The above-described area shall be and hereby is assigned to the First
Councilmanic District of the City of South Bend, Indiana.
SECTION VI. This Ordinance shall be in full force and effect from and after its
passage by the Common Council, approval by the Mayor, and proper legal publication.

Please be advised that the Area Plan Commission will hold
a public hearing in the Council Chambers, located on the
4th Floor of the County-City Building, on Tuesday, April
18, 2000 at 3:30 p.m. local time. At this public hearing,
the following will be considered:
A proposed ordinance initiated by the
Common Council of the City of South Bend
to zone from "A" Agricultural to "D"
Light Industrial, "A" Height and Area,
property located on the east side of
Olive Road, approximately 1,300 feet

The rules of the Commission require that you or your
