AN ORDINANCE ANNEXING TO AND BRINGING WITHIN THE
CITY LIMITS OF SOUTH BEND, INDIANA, CERTAIN LANDS
BE IT ORDAINED BY THE COMMON COUNCIL OF THE CITY OF SOUTH
BEND, INDIANA:
Section 1:
That the following described property in St. Joseph
County, State of Indiana, is hereby annexed to and brought
within the City of South Bend, Indiana:
Beginning at the intersection of the present city
limits and the east section line of Section 26, T37N7
R2E, thence south along the east section line of Sec. 26,
T37N, R2E, to a point which is 440 feet, more or less,
north of the east -west centerline of said Sec. 26, thence
west parallel with the east -west centerline of Sec. 26
for a distance of 400 feet, more or less, thence south
parallel with the east section line of said.Sec. 26 for
a distance of 400 feet, more or less, to the north right -
of -way line of Ireland Road, thence west along the
north right -of -way line of Ireland Road to the inter-
section of said right -of -way and the east right-of-way
line of the Pennsylvania Railroad, thence northeast
along the east right -of -way line of the Pennsylvania
Railroad to an intersection of said right -of -way line
and the present city limits, thence east along the
present city limits to the place of beginning containing
approximately 100.7 acres.
Section 2:
This Ordinance shall be in full force and effect from
and after its enactment, approval by the Mayor and legal
publication.

VJE, the undersigned, do remonstrate and object to the
passage by the Common Council of the City of South Bend, Indiana,
of Ordinance No. entitled "An Ordinance Annexing To And
Bringing within The City Limits of South Bend, Indiana, Certain
Lands11, which purports to annex the following described real
estate to the City of South Bend, to -wit:
Beginning at the intersection of the present city
limits and the east section line of Section 26, T37N,
R2E thence south along the east section line of Sec. 26,
TE M, R2E2 to a point which is 440 feet, more or less,
north of the east -west centerline of said Sec. 269 thence
west parallel with the east west centerline of Sec. 26
for a distance of 400 feet, more or less, thence south
parallel with the east section line of said Sec. 26 for
a distance of 400 feet, more or less, to the north right -
of -way line of Ireland Road, thence west along the
north right -of -way line of Ireland Road to the inter-
section of said right -of -way and the east right-of-way
line of the Pennsylvania Railroad, thence northeast
along the east right -of -way line of the Pennsylvania
Railroad to an intersection of said right -of -way line
and the present city limits, thence east along the
present city limits to the place of beginning containing
approximately 1000 acres,
as the undersigned do constitute a majority of the owners of
land in the above described territory and, further, they are
the owners of more than Seventy Five (750) per cent of the
assessed valuation of the land in the above described territory.

Gentlemen:
August 5, 1960
The attached proposed ordinance originated by the Common
Council to annex to the City of South Bend, Indiana°�
proper y generally described as bounded on the north by
the present city limits; on the east by the east section
line of Section 26, T37N, R2E; on the south by Ireland
Road and on the west by the Pennsylvania Railroad tracks
containing approximately 100.7 acres was legally adver-
tised on June 25, 1960 and given public hearing under
date of July 7, 1960. The following action was taken:
After due consideration the Commission found that:
1. The annexation is in the best interests of
the city and of the territory sought to be
annexed.
2. The area is urban in character, being an
economic and social part of the annexing city.
3. The city is financially able to provide muni-
cipal services to the annexed area within
the reasonably near future.
4. The area sought to be annexed is needed for
development of the city in the reasonably near
future.

5. The lines of the annexation are so drawn as
to form a compact area abutting the municipality.
It was therefore duly moved, seconded and unanimously
carried that the petition be recommended favorably
to the Common Council.
