HUFF DIRECTOR OF PLANNING The Honorable Common Council City of South Bend South Bend, Indiana Gentlemen: July 11, 1960 The attached petition of John Van Vynckt, et a1, to rezone Lots Numbered 79, 80, and 81 in the recorded Plat of Belmont Addition to the City of South Bend, Indiana, generally described as the northwest corner of Jefferson Boulevard and 36th Street, from "A" Residential Use to "C -1" Commercial Use and "A" Height and Area District was legally advertised on June 25, 1960 and given public hearing under date of July 71 1960. The following action was taken: After due consideration the Commission found that the proposed zoning would tend to be an encroach- ment of commercial use on residential areas and that it was not in keeping with the general charac- ter of the existing residential development. It was therefore duly moved, seconded and carried that the petition be recommended unfavorably to the Common Council. STATE OF INDIANA ) VERIFIED PETITION TO CHANGE ZONING ) SS: CLASSIFICATION OF REAL ESTATE FROM ST. JOSEPH COUNTY ) "A" RESIDENTIAL TO "C -1" COMMERCIAL "A" HEIGHT AND AREA DISTRICT TO: HON. MAYOR VOORDE AND COMMON COUNCIL OF THE CITY OF SOUTH BEND, INDIANA Come now the undersigned Petitioners and respect- fully show and submit the following: 1. The said Petitioners, John Van Vynckt and Luella Van Vynckt, husband and wife, are the owners in fee simple, and Petitioner Joseph A. Bauters, has an interest therein, by vir- tue of having an exclusive option to purchase from the said owners, of the following described real estate, situate in St. Joseph County, State of Indiana, to -wit: Lots 79, 80 and 81 in the recorded Plat of Belmont Addition to the City of South Bend, also commonly known as 3521, El Jefferson, 3517 E. Jefferson, and 3513 E. Jefferson, respectively, consisting of three lots with a total frontage on Jefferson of approximately 135 feet, and a depth on 36th Street of approximately 125 feet. 2. That the said real estate is now presently zoned and classified as residential property, Class "A ". 3. That it would be to the advantage of the said owners and interested party, as well as all adjoining property owners, and that the best uses and purposes of the said real estate would be served if said property were classified as commercial property, Class "C -111, "A" Height and Area District. WHEREFORE, your Petitioner hereby respectfully pe- titions to rezone and reclassify the above described real estate to commercial property, Class "C -1 ", "A" Height and Area District.
