An Ordinance of the City of South Bend appropria- ting the sum of One Million, One Hundred Thousand Dollars ($1,100,000) to be applied on the cost of the construction of storm, sanitary and other sewers to Maple Road for the Northwest Industrial Development area, as well as in the area of LaFayette Boulevard and Iroquois Avenue located North of the St. Joseph River and in the Chippewa Avenue and Ireland Road areas; also, for the acquiring of lands and rights -of -way for a new Sample Street bridge, and for making major thorough- fare improvements and acquiring of rights -of -way therefor, together with the incidental expenses to be incurred in connection therewith. WHEREAS, the Board of Public Works and Safety of the City of South Bend has found that it would be for the best interests of said City and its citizens to provide for the construction of storm, sanitary and other sewers to Maple Road for the Northwest Industrial Development area, as well as in the area of LaFayette Boulevard and Iroquois Avenue located North of the St. Joseph River and in the Chippewa Avenue and Ireland Road areas, and for the incidental expenses in connection with the foregoing, including engineering and surveys; also, for the acquiring of lands and rights -of -way for a new Sample Street bridge, and for making major thoroughfare improvements and acquiring of rights- of-way therefor, together with the incidental expenses to be incurred in connection therewith; and has determined that the estimated cost of said projects and the incidental expenses necessary to be incurred in connection therewith, including the issuance of bonds, will be in the approximate amount of One Million, One Hundred Thousand ($1,100,000) Dollars; and WHEREAS, the Board of Public Works and Safety has filed a request for an appropriation in the amount of One Million, One Hundred Thousand Dollars (1,1000000) for -said purposes, which request has been approved by the City Controller with the recommendation that the funds necessary to cover such appropriation be obtained by the issuance and sale of general obligation bonds of the City; and WHEREAS, a petition has been filed under the provisions of Chap- ter 119 of the Acts of 1937 by more than fifty (50) owners of taxable real estate in the City of South Bend, requesting the Common Council to issue bonds in an amount not exceeding One Million One Hundred Thousand Dollars ($1,100,000) for the purpose of procuring funds to be applied on the cost of the projects hereinbefore described; and WHEREAS, the Council now finds that the construction of such improvements and the acquisition of such lands and rights -of -way are necessary and will be of general benefit to the City and its citizens; and WHEREAS, the Council now finds that the City has no funds available or provided for in the existing budgets and tax levies which may be applied on said projects, making it necessary to authorize the issuance of bonds of the City in order to procure such funds, and that an extra- ordinary emergency exists for the making of the additional appropriation hereinafter set out; now therefore, BE IT ORDAINED BY THE COMMON COUNCIL OF THE CITY OF SOUTH BEND: Section 1. That the sum of One Million One Hundred Thousand Dollars ($1,100,000) be and the same is hereby appropriated out of the proceeds of the bonds designated as "Municipal Bonds of 196111, hereto- fore authorized to be issued for application on the cost of the con- struction of storm, sanitary and other sewers to Maple Road for the Northwest Industrial Development area, as well as in the area of LaFayette Boulevard and Iroquois Avenue located North of the St. Joseph River and in the Chippewa Avenue and Ireland Road areas; also, for the acquiring of lands and rights -of -way for a new Sample Street bridge and for making major thoroughfare improvements and acquiring of rights -of -way therefor, and the incidental expenses necessary to be incurred in connection with such projects and the issuance of bonds on account thereof. -2- Section 2. This ordinance shall be in full force and effect from and after its passage and signing by the Mayor. CLERK-5OUTHBEND- RESOLUTION OF THE BOARD OF I' IC WORKS AND SAFETY OF THE CITY OF _-SOUTH BEND WHEREAS, the Board of Public Works and Safety of the City of South Bend has determined that it would be for the best interests of said City and its citizens to provide for the construction of storm, sanitary and other sewers to Maple Road for the Northwest Industrial Development area, as well as in the area of LaFayette Boulevard and Iroquois Avenue located North of the St. Joseph River and in the Chippewa Avenue and Ireland Road areas, and that the construction of such improvements is necessary in order to protect the well —being and property of the citizens and will be of general benefit to the entire City; and WHEREAS, said Board has determined that the funds necessary to be provided to pay the cost of said projects, including engineering and surveys and the incidental expenses necessary to be. incurred in connection therewith, will be in the amount of Eight Hundred Seventy Thousand Dollars (38709000); and WHEREAS, the Board of Public Works and Safety of the City of South Bend has further determined that it would be for the best interests of said City and its citizens to provide for the acquiring of lands and rights —of —way for a new Sample Street bridge, and, further, to provide for major thoroughfare improvements and acquisition of rights - of —way therefor, and that the making of such improvements and the ac- quiring of such lands and rights —of —way are necessary in order to protect the well —being and property of the citizens and will be of general benefit to the entire City; and WHEREAS, said Board has determined that the funds necessary to be provided to pay the cost of the foregoing projects, including all Incidental expenses necessary to be incurred in connection therewith, will be in the amount of Two Hundred and Thirty Thousand Dollars (5230000); ngw therefore.. BE IT RESOLVED by the Board of Public Works and Safety of the City of South Bend that this Board request the City Controller and Common Council to take proper steps immediately to provide funds necessary for said purposes, in the amount of One Million One Hundred Thousand Dollars ($1,100,000), and to that end that a copy of this resolution be filed with the City Controller, and presented to the Common Council as soon as may be done. Adopted this second day of October o61. To the Common Council of the City of South Bend: The Board of Public Works and Safety of the City of South Bend requested an appropriation of One Million One Hundred Thousand Dollars ($1,100,000) for application on the cost of the construction of storm, sanitary and other sewers to Maple Road for the Northwest Industrial Development area, as well as in the area of LaFayette Boulevard acid Iroquois Avenue located North of the St, Joseph River and in the Chippewa Avenue and Ireland Road areas; also, for the acquiring of lands and rights -of -way for a new Sample Street bridge and for making major thoroughfare im- provements and acquiring of rights -of -way therefor, together with the incidental expenses to be incurred in connection therewith, I recommend that said appropriation be made, and I am sub- mitting herewith for consideration of the Council a form of ordinance authorizing such appropriation, In order to provide funds to meet said appropriation it will be necessary to authorize, issue and sell bonds of the City in the amount of One Million One Hundred Thousand Dollars ($1,100,000), and I am submitting herewith a form of ordinance drawn for that purpose, Dated this 7" day of _- , 1961.
