An Ordinance Amending Ordinance #3702 Adopted by
the Common Council on the 13th day of June, 1949.
BE IT ORDAINED by the Common Council of the City of
South Bend, Indiana, that an ordinance #3702 adopted by this
Common Council on the 13th day of June, 1949, more commonly
known as the Zoning Ordinance, be amended by rezoning a certain
parcel of land located in the City of South Bend, St. Joseph
County, State of Indiana, known and described as follows, to -wit:
Lots Numbered Thirty -eight (38)
and Thirty -nine (39) as shown on
the recorded Plat of Olive Height's
Addition to the City of South Bend,
St, Joseph County, Indiana.
from "B" Residence District and "B" Height and Area District to
"C -1" Commercial District and "C" Height and Area District, and
that said ordinance shall be in effect from and after its pass-
age and legal publication.

Gentlemen:
The attached petition of George K. and Cecelia Buechner
to rezone Lots Numbered 38 and 39, as shown on the re-
corded Plat of Oliver Heights Addition to the City of
South Bend, Indiana, from "A" Residential Use and "A"
Height and Area District to "C -1" Commercial Use and
"C" Height and Area District was legally advertised. under
date of August 28, 1961 and. given public hearing on
September 7, 1961. The following action was taken:
After due consideration the Commission found
that surrounding land. use was predominantly
commercial, that the two lots in question have
been vacant for many years and that commercial
zoning would be in the best interests of the
general area and the City of South Bend.. It
was therefore duly moved, seconded, and unani-
mously carried. that the petition be recommended
favorably to the Council.
