AN ORDINANCE AMENDING ORDINANCE NO, 3702, COMMONLY
KNOWN AS THE ZONING ORDINANCE OF THE CITY OF SOUTH
BEND
BE IT ORDAINED BY THE COMMON COUNCIL OF THE CITY SOUTH BEND.
Section 1. Ordinance No. 3702, being a zoning Ordinance of the City of South
Bend, Indiana, be and the same hereby is amended so that the zoning classification
of the following described real estate in the City of South Bend, St. Joseph County,
Indiana, to wit:
That part of Kaley Street north of Kenwood and south of Bertrand Street
which was vacated by previous petition,
be and the same hereby is changed from "no" zoning to "D" Eight Industrial Use
District and "F" Height and Area District,
Lots 82 — 83 and 84 in Kaleys ist Subdivision in the City of.South Bend, Indiana,
be and the same hereby is changed from "C" Commercial Use District and "D" Height and
Area District to "D" Light Industrial Use District and "F" Height and Area District.
Lots 125.E 126 and 127 in Part of Kaleys 2nd Subdivision in the City of South
Bend, Indiana,
be and the same hereby is changed from "B" Residence Use District and an "A" Height
and Area District to a "D" Light Industrial Use District and an "F'! Height and Area
District.
The vacated portion of an east and west alley lying between Lots,
125, 1269 and 127 in Part of Kaleys 2nd Subdivision and Lots 82,
83, and 84 in Kaleys 1st Subdivision, running from the vacated portion
of Kaley Street east to the first north and south alley west of Meade Street,
all in the City of South Bend, Indianag
be and the same hereby is changed from "no" zoning to a "D" Light Industrial Use
District and an "F" Height and Area District.
Section 2. This Ordinance shall be in full force and effect from and after its
passage by the Common Council, approval by the Mayor and legal publication.

The attached petition of Bendix Aviation Corporation to
rezone Lots No. 125, 126 and 127 in Part of Kaleys 2nd
Subdivision in the City of South Bend, Indiana, from a
"B" Residential Use District and an "A" Height and Area
District to a "D" Light Industrial Use District and a
"F" Height and Area District; Lots No. 82, 83, and 84 in
Kaleys 1st Subdivision in the City of South Bend, Indiana
from "C" Commercial Use District and "D" Height and Area
District to "D" Light Industrial Use District and "F"
Height and Area District; that part of Kaley Street north
of Kenwood and south of Bertrand Street which was vacated
by a previous petition, from "no" zoning to "D" Light
Industrial Use District and "F" Height and Area District;
the vacated portion of an east and west alley lying
between Lots 125, 126 and 127 in Part of Kaleys 2nd
Subdivision and Lots 82, 83, and 84 in Kaleys 1st Sub-
division, running from the vacated portion of Kaley
Street east to the first north and south alley west of
Meade Street, all in the City of South Bend, Indiana,
from "no" zoning to a "D" Light Industrial Use and a
"F" Height and Area District was legally advertised
on February 29, 1960 and given public hearing under date
of March 10, 1960. The following action was taken:
After due consideration the Commission found
that the best possible use of subject land is
Common Council -2- March 11, 1960
for industrial purposes. It was therefore duly
moved, seconded and carried that the petition be
recommended favorably to the Common Council.
