AN ORDINANCE OF THE COMMON COUNCIL OF THE CITY OF SOUTH
BEND, INDIANA, ANNEXING TO AND BRINGING WITHIN THE CITY
LIMITS OF SOUTH BEND, INDIANA CERTAIN LAND IN CENTRE
TOWNSHIP CONTIGUOUS THEREWITH;
ROYAL OAK ESTATES AND COMMUNITY BAPTIST CHURCH
STATEMENT OF PURPOSE AND INTENT
A petition for voluntary annexation of 89.674 acres located in Centre Township, St.
Joseph County, Indiana, has been filed by one hundred percent (100%) of the owners of
land in the territory sought to be annexed. It is the intent and purpose of this Ordinance to
annex this territory to the City of South Bend, Indiana.
THEREFORE, BE IT ORDAINED BY THE COMMON COUNCIL OF
THE CITY OF SOUTH BEND, INDIANA AS FOLLOWS:
SECTION I. That the following described real estate situated in St. Joseph County, _
Indiana, being contiguous by more than one-eighth (1/8) of its aggregate boundaries with
the present boundaries of the City of South Bend, Indiana, shall be and hereby is annexed
and brought within the City of South Bend:
A parcel of land being of the East Half of Section 36, Township 37 North, Range 2 East,
Centre Township, St. Joseph County, Indiana and being more particularly described as
follows:
Commencing at the intersection of the Centerline of Johnson Road, also being the Old
Indiana-Michigan Boundary Line, and the East Line of said Section 36, also being the
Centerline of Miami Highway; thence North 89 Deg 50 Min 52 Sec West along said
Centerline of Johnson Road, 1,307.63 feet to the Place of Beginning. Thence Northerly
40.00 feet to the North Right-Of--Way Line of Johnson Road; thence North 89 Deg 50
Min 52 Sec West along said North Right-Of--Way Line, 1,206.75 feet; thence South ODeg
11 Min 27 Sec West, 285.12 feet; thence North 89 Deg 48 Min 33 Sec West, 177.00 feet
to the North-South Centerline of said Section 36; thence South 0 Deg 11 Min 27 Sec
West along said North-South Centerline, 1,600.83 feet; thence North 86 Deg 41 Min 40
Sec West, 1377.72 feet; thence Easterly 643.42 feet; thence Northerly 320.74 feet; thence
Easterly 694.58 feet to the said East Line of said Section 36; thence Northerly along said
East Line, 75.00 feet; thence Westerly 280.00 feet; thence Northerly 887.00 feet; thence
Westerly 1,047.13 feet, thence Northerly 638.20 feet to the Place of Beginning.
SECTION II. That the boundaries of the City of South Bend, Indiana, shall be and are
hereby declared to be annexed so as to include the real estate of the above described
parcel as a part of the City of South Bend, Indiana.
SECTION III. That the above described real estate shall be and hereby is assigned to the
5th Councilmanic District of the City of South Bend, Indiana.
SECTION IV. This ordinance shall be in full force and effect from and after its
enactment, approval by the Mayor, and legal publication.

PETITION FOR. THE VOLUNTARY ANNEXATION INTO THE CITY OF
SOUTH BEND, INDIANA
We, the undersigned, make application to the Common Council of the City of South
Bend, Indiana, for the voluntary annexation of land to the City of South Bend, Indiana,
for land in Centre Township, St. Joseph County, Indiana, and in support of which petition
alleges and affurns as follows:
1. We are the property owners (hereinafter "petitioners") of a parcel of land more
particularly described in Exhibit "A".
2. Petitioners desire that the parcel be annexed to the City of South Bend, Indiana, by
proper ordinance:
3. That this petition is signed by at least fifty-one percent (5.1 %) of the owners on the
territory sought to be annexed and the .owners of seventy-five percent (75%) of the
total assessed value of the land for property tax purposes.
4. The property sought to be annexed is generally located at South of Johnson Road and
west of Miami Highway.
5. The parcel is 89.674 acres in size following uses on it: (a) a church and (b) a single
family home subdivision.
6. That the parcel will be used the same as number five (5) above.
7. Said land is 16.97% contiguous with the City of South Bend, Indiana.
