AN ORDINANCE TO AMEND SECTION 24 AND PARAGRAPH 4 O SECTION 25 OF ARTICLE V OF ORDINANCE NO, 3200 AS AMENDED ENTITLED tPORDINANCE PROVIDING FOR, THE ADMINISTRATION AND ENFORCEMENT OF THE REGULATIONS GOVERNING TRAFFIC UPON THE PUBLIC STREETS OF THE CITY OF SOUTH BEND ESTABLISHING A CITY TRAFFIC ENGINEER AND SETTING FORTH HIS DUTIES, ALSO ESTABLISHING A TRAFFIC BUREAU AND SETTING FORTH THE MEMBERSHIP AND DUTIES OF SUCH BUREAU AND REPEALING SUCH PARTS OF ORDINANCES THAT MAY BE IN CONFLICT HEREWITH ONLY INSOFAR AS THEY CONFLICT AND SUPPLEMENTING THE TRAFFIC ORDINANCES, BUT IN NO WAY REPEALING THE INTENT OR PURPOSES OF SAID ORDINANCES" PASSED FEBRUARY 8, 1937, ALSO KNOWN AS CHAPTER 29, SECTION 16 AND SUB - SECTION (c) OF SECTION 17 OF THE MUNICIPAL CODE OF THE CITY OF SOUTH BEND, INDIANA, 1949, GENERAL ORDINANCE NO. 3709. BE IT ORDAINED by the Common Council of the City of South Bend, Indiana: SECTION I. That Section 24 of Article V of Ordinance No. 3200 as amended, which ordinance was adopted, on the 8th day of February, 1937, be and the same is hereby amended to read as follows: Section 24. TRAFFIC VIOLATIONS DEPARTMENT CREATED.-- (a) There is hereby established in the office of the City Clerk of this city a Traffic Violations Bureau to assist the City Court with the clerical work of traffic cases. (b) The City Judge of this City may designate the fines to be paid for first, second, and third offenses which may be satisfied by payment of the same at the department, provided said fines are within the limits established as penalties for violations of the provisions of the traffic laws and regulations of this city. SECTION II That paragraph 4 of Section 25 of Article V of Ordinance No. 3200 as amended be and the same is hereby amended to read as follows: Section 25. DUTIES OF TRAFFIC VIOLATIONS DE- PARTMENT. -- 4. If a violator of the restrictions on stopping or parking under traffic ordinances of this city does not appear in response to a notice affixed to such motor vehicle within a period of 48 hours, the traffic viola- tions department shall send to the owner of the motor vehicle to which the notice was affixed a letter informing him of the violation and warning him that he will be held responsible for the appearance of the offender and that in the event such letter is disregarded for a period of five (5) days, it shall be presumed that said owner is guilty of the violation set out in said notice and a complaint will be filed and a warrant of arrest issued. SECTION III. This Ordinance shall be in full force and effect from and after its passage by the Common Council, its approval by the Mayor and the fulfillment of all statutory requirements relating thereto.
