ORDINANCE NO. 4286 - - -59
AN ORDINANCE ANNEXING TO THE CITY OF SOUTH BEND CERTAIN
TERRITORY CONTIGUOUS THERETO AS AMENDED
Be it ordained by the Common Council of the City of South Bend, Indiana:
Section 1
That the following described territory contiguous to the incorporated City
of South Bend, in St. Joseph County, Indiana, to -wit:
Beginning at a point where the North line of the City limits inter-
sects the Westerly bank of the St. Joseph River; thence Northerly
along the Westerly bank of the St. Joseph River to the South right -
of -way line of Darden Road; thence Westerly along the South right -
of -way line of Darden Road to a point Six Hundred Fifty -eight and
Ninety -five Hundredths (658.95) feet East of the place where the
South right -of -way line of Darden Road intersects the East line of
Lilac Road; thence North Four Hundred Six and eighty -four Hundredths
(406.84) feet; thence West Six Hundred Fifty -eight and Ninety -five
Hundredths (658.95) feet to the East right -of -way line of Lilac Road;
thence South along the East right -of -way line of Lilac Road One Thousand
Twenty and Twenty -two Hundredths (1,020.22) feet; thence East Three
Hundred Twenty -three and twenty -three Hundredths (323.23) feet; thence
South One Hundred Ninety -six and no Hundredths (196.00) feet; thence
West Three hundred Twenty -four and Six - tenths (324.6) feet; thence
South Nine Hundred Seventy -eight and Twenty -five Hundredths (978.25)
feet; thence East Five Hundred Three (503) feet; thence South Three
Hundred Twenty -three (323) feet; thence East Three Hundred (300) feet;
thence South Thirty -two and Five Tenths (32.5) feet; thence East
Three Hundred Fifty (350) feet; thence South Four Hundred Seventy -seven
and Five Tenths (477.5) feet to the centerline of Cleveland Road; thence
East along the centerline of Cleveland Road to the place of beginning,
containing One Hundred Seven (107) acres, more or less,
be and the same is hereby annexed to said City of South Bend, all of which said
contiguous territory shall hereafter form a part of the said City of South Bend and
be within its jurisdiction, and said territory is hereby consolidated with and made a
part of the said City of South Bend, subject to the following conditions:
Section 2
1. That a parcel of land between 4 and 5 acres in area be reserved
for a period of time not to exceed three years for acquisition
through purchase by or gift to the City of South Bend.
2. That the location of said land be subject to the approval of the
Board of Park Commissioners.
3. That said land if not dedicated to the City of South Bend be sold to
the City at the average cost per acre to the developer at the time of
the developer's purchase.
This Ordinance shall be in full force and effect from and after its
enactment, approval by the Mayor, and legal publication.

Dear Councilman Muszynski:
November 6, 1959
Would you at the next Council meeting move to :amend an
ordinance annexing 107 acres to the City of South Bend
that the Planning Commission considered under date of
November 5, 1959 by attaching the following conditions
to the adoption of the ordinance. The attachment of
these conditions is authorized under the authority of
Chapter 269, Acts of General Assembly, 1955.
1. That a parcel of land between 4 and 5 acres in
