BE IT ORDAINED by the City Council of the Civil City of South Bend, Indiana: SECTION 1: That Ordinance No. 3702, as amended, commonly known as "The Zoning Ordinance of South Bend, Indiana" be amended by changing the "Use District Map" and the "Height and Area District Map ", which are a part of said ordinance, in the following manner, to wit: 1. That the Area as shown on the "Use District Map ", bounded by Howard Street on the North, the alley- way between St. Frances Street and Eddy Street on the East, the vacated alleyway between Howard Street and Corby Street on the South and St. Frances Street on the West, be changed from 4" Residential District to "C" Commercial District, and 2. That the area on the "Height and Area District Map" described in Paragraph 1 above, be changed from "A" Height and Area to "D" Height and Area. 3. That the "Area" described above is more particularly described as being Lots 113, 114, 115 in Sorints Second Addition to the City of South Bend. Riggs, et al, to rezone Lots Numbered 113, 114 and 115 in Sorins Second Addition to the City of South Bend, Indiana located at 920 North Frances Street from "B" Residential Use and "A" Height and Area District to "C" Commercial Use and "D" Height and Area District was legally advertised on September 21, 1959 and given public hearing under date of October 1; 1959• The following action was taken: After due consideration the Commission found that commercial zoning of subject property would result in a logical expansion of commercial zoning. It was therefore duly moved, seconded and unanimously carried that the petition be recommended favorably to the Council. Also attached is a consent petition bearing fourty -one signatures, being approximately 98 per cent of the property owners in the immediate vicinity. BEFORE THE COMMON COUNCIL OF THE CITY OF SOUTH BEND PETITION FOR REZONING OF REAL ESTATE TO: The common Council of the City of South Bend, Indiana Come now Austin F. Riggs and Lila A. Riggs, husband and wife; Lew A. Dokey and Nellie Dokey, husband and wife; Lowell L. Dokey and Myrtle E. Kokey, husband and wife; George B. Syson and Sarah F. Syson, husband and wife; Antoni Marcankowski and Antonina Marcankowski, hus- band and wife; and Arthur F. Reasor, and respectfully petition and show this honorable body the following; 1. That the petitioners each own parts of the following des- cribed real estate in the City of South Bend, St. Joseph County, State of Indiana and the total of said parts is all of, Lots Numbered 113, 114, and 115 in Sorin's Second Addition to the City of South Bend, which is now zoned and classified under the zoning ordiance of the City of South Bend, being known as Ordinance Number 3702, as amended, as "B" residential district and "A" height and area district. 2. That petitioners herein are requesting to have the above described real estate rezoned and reclassified by amendment of said zoning ordinance from the above classification to "C" commercial district and "D" height and area district. 3. That in the event this petition is granted and said re- zoning is permitted, petitioners are under contract to transfer their said real estate to Arthur F. Reasor and his assignees who intend to clear the above described real estate together with Lots Numbered 7,8, and 9 and the North part of Lot Numbered 10 of their present improvements and construct thereon a modern building suitable for supermarket use providing for adequate parking facilities. 4. Petitioners respectfully point out that the above des- cribed real estate constitutes the Northwest Quarter of a City Block bounded by Howard St. on the North, Eddy St. on the East, Corby St. on the South, and St. Francis St. on the West and that all of said Block with the exception of the above described real estate is pre- sently, zoned "C" commercial. 5. Attached hereto is a Flat of the City Block in which the above described real estate is located showing the location of the proposed construction. WHEREFORE your petitioners respectfully pray that the zoning ordinance of the City of South Bend may be amended to allow the re- zoning as above proposed. AUSTIN F. WELL L.
