AN ORDINANCE AUTHORIZING THE RECEIPT OF REALA ND PERSONAL PROPERTY KNOWN AS THE PALACE THEATRE PROPERTY FROM THE E. M. MORRIS FOUNDATION, INC. WHEREAS the E. M. Morris Foundation, Inc. has signified its willingness to make a gift to the Civil City of South Bend of all its right, title and interest in and to a certain tract of improved real estate in the City of South Bend, St. Joseph County, Indiana, described as follows: Lot Number 4 and 42 feet off the North side of Lot Number 5 as shown on the Original Plat of the Town, now City, of South Bend, with a frontage on Michigan Street in said City of approximately 108 feet and a depth of approximately 165 feet, together with the furniture, furnishings and fixtures therein contained, which is now generally known as the Palace Theatre property, such property to be used by said City for exclusively public purposes, to provide the residents of South Bend and the surrounding territory an auditorium for lectures, legitimate theater presentations, symphony concerts and other civic and educational pur- poses; and WHEREAS such property will be of great benefit to the City of South Bend and will serve the social and cultural welfare of the residents of South Bend and the surrounding community; and WHEREAS the Civil City of South Bend should, in the interests of public welfare, accept such gift; NOW, THEREFORE, BE IT ORDAINED BY THE COMMON COUNCIL of the City of South Bend: SECTION I. That the Civil City of South Bend will accept the gift of the E. M. Morris Foundation, Inc. of all its right, title and interest in and to the following described real estate in the City of South Bend, St. Joseph County, Indiana: Lot Number 4 and 42 feet off the North side of Lot Number 5 as shown on the Original Flat of the Town, now City, of South Bend, with a frontage on Michigan Street in said City of approximately 108 feet and a depth of approximately 165 feet, together with the furniture, furnishings and fixtures therein contained. SF♦CTION II. That the Mayor is hereby authorized and directed to accept a deed of gift of said real estate, together with the furniture, furnishings and fixtures therein contained, from the E. M. Morris Foundation, Inc, and express his appreciation on behalf of the Common Council and the residents of the City of South Bend to the said E. M. Morris Foundation, Inc. for its generosity. SECTION III.
